2. A person who commits a crime by subjecting others to physical or emotional coercion or subjugation shall be considered the perpetrator of the crime. 3. If a crime is committed by clearly exceeding the threat posed by others, it shall not be considered as coercion or domination. Article 4.5. Reasonable risk 1. When conducting production, analysis, and research work in order to achieve results beneficial to the public, measures to prevent risks prescribed by laws and standards have been taken, but if damage or harm to the interests protected by this law is caused, it shall not be considered a crime. 2. Taking a risk in a dangerous situation that could cause damage to human life, widespread or catastrophic, or experimenting on the human body is not considered a reasonable risk. /This section was amended by the law of February 2, 2017/ Article 4.6. Fulfillment of orders and assignments 1. Damage to the interests protected by this law is not considered a crime if a military serviceman or law enforcement officer fails to comply with the written or oral mandatory orders or tasks given by a higher-level official without knowing or knowing that they are illegal. Officials who give illegal orders and tasks are considered to be the perpetrators of the crime. /This section was amended by the law of May 11, 2017/ 2. If an obviously illegal order or decision to commit an obviously criminal act or omission specified in this law falls within the duties and authority of a military serviceman or a law enforcer, the military serviceman, Law enforcers are considered to be executors of the crime, and officials who gave orders and tasks are considered to be executors of the crime using others. /This section was amended by the law of May 11, 2017/ 3. In case of non-fulfilment of an obviously illegal order or assignment, the person who gave the order or assignment shall be deemed to have attempted to commit the crime. CHAPTER FIVE OBJECTIVES AND TYPES OF CRIMINAL RESPONSIBILITY /The title of this chapter was amended by the law of May 11, 2017/ Article 5.1. Purpose of criminal liability 1. The purpose of criminal responsibility is to restrain the person and legal entity who committed the crime, to restore the rights violated due to the crime, to compensate for the damage, to prevent the crime, and to rehabilitate the person who committed the crime. 2. Criminal liability consists of penalties and coercive measures specified in this law. 3. At the time of committing a crime, a person who is of legal age and capable of taking responsibility for the crime shall be held criminally responsible in accordance with the grounds and procedures provided for in this law. /This section was amended by the law of January 10, 2020./ 4. Criminal liability shall be imposed on the legal entity in cases specified in the special class of this law. 5. Legal persons shall be held criminally liable in accordance with the grounds and procedures provided for in this law, taking into account the circumstances of the crime, the nature of the crime, and the amount of damage and harm. /This item was amended by the law of May 11, 2017/ Article 5.2. Type of punishment 1. The person who committed the crime shall be sentenced as follows: 1.1. fine; 1.2. sentence to perform community service; 1.3. penalty of restricting the right to travel; 1.4. imprisonment; 1.5. penalty of disqualification. 2. Fines, community service, restriction of travel rights, imprisonment shall be the main punishment, and disqualification shall be the additional punishment. /This part was modified by the law of May 11, 2017/ 3. The special class of this law specifies the type and amount of the basic punishment for the crime. Article 5.3. Penalties 1. A fine equal to the penalty unit (hereinafter referred to as "unit") specified in the special class of this law is called a fine. /This section was amended by the law of May 11, 2017/ 2.
