Notes: The 2021 Act strengthens the provisions of the 2004 Act, by improving the geographical scope of the law, particularly to data controllers who carry out processing operations from Burkina Faso, even though they originate from outside the country. It also broadens its scope to the supervision of cross-border data transfers. The law also improves security requirements such that data controllers who transfer data outside to a third country must enter into a contract with the data recipient, to ensure the return of data and its encryption. There is also a requirement on data localisation, to ensure that Burkina Faso health data is hosted in the country, unless where the authority exempts it.
