69 Clause 2 defines terms and expressions used in the Bill. In particular — (a) the clause defines a statement as any word, number, image (moving or otherwise), sound, symbol or other representation, or a combination of any of these; (b) the clause defines a statement of fact as one that a reasonable person perceiving it would consider to be a representation of fact; and (c) the clause defines a false statement of fact as one that is false or misleading whether wholly or in part and whether on its own or in the context in which it appears. Clause 3 sets out what it means to communicate a statement or material in Singapore. For the purposes of Part 2 (Prohibition of communication of false statements of fact in Singapore), a statement is communicated in Singapore if it is made available to one or more end-users in Singapore on or through the internet, MMS or SMS. For the purposes of the other Parts, a statement or material is communicated in Singapore if it is made available to one or more end-users in Singapore on or through the internet. Further, a person communicates a statement or material in Singapore under the Bill if the person causes it to be so communicated. Clause 4 gives a non-exhaustive definition of the expression “in the public interest”, which is part of a condition for the making of various directions under the Bill. Clause 5 sets out the purposes of the Bill. Clause 6 enables the appointment of a Competent Authority for the purposes of the Bill. Under the Bill, the Competent Authority has various powers, including to — (a) issue various directions or declare an online location as a declared online location, under the instruction of a Minister; (b) direct (under the instruction of a Minister) a person served with a direction under Part 4 to take measures to remedy any non-compliance with a requirement under clause 24 (correction notices must be easily perceived); and (c) direct (under the instruction of a Minister) various persons to appoint a person to accept service of directions in Singapore.
