73 Where the internet intermediary is a prescribed internet intermediary, it may be required to carry out the following additional acts: (a) communicate in Singapore the correction notice by means of its service to all end-users who access identical copies of the subject material by means of that service at any time after the specified time; (b) communicate in Singapore the correction notice by any means to all end-users that it knows had accessed the subject material or identical copies of the material by means of that service before the specified time; (c) if it disables access to the subject material at any time after the issue of the Direction and before the Direction expires, or is set aside or cancelled, communicate in Singapore the correction notice by means of its service to specified end-users of the service. Clause 22 provides for the making of a Disabling Direction. This is a direction to the internet intermediary that provided the internet intermediary service by which the communication of the material was carried out, to disable access by end-users in Singapore to the subject material provided on or through the service by a specified time. If the internet intermediary is a prescribed internet intermediary, it may also be required to disable access by end-users of the service in Singapore to identical copies of the subject material provided on or through the service, and to communicate a correction notice. Clause 23 provides for the making of a General Correction Direction. This is a direction to prescribed internet intermediaries, providers of mass media services and other prescribed persons, to communicate in Singapore, publish, broadcast, transmit by a telecommunications service, or give to specified persons, a correction notice. Clause 24 requires correction notices under this Part to be easily perceived. The clause defines what is meant by “easily perceived”. The clause has a “safe harbour” provision in that a correction notice is taken to be easily perceived if it complies with measures prescribed by regulations. If the Minister on whose instruction the Part 4 Direction is issued is of the view that the notice is not easily perceived, the Minister may instruct the Competent Authority to make an order directing the person to whom the Part 4 Direction is issued, to remedy the non-compliance (called a Remedial Order). Clause 25 sets out the provisions that apply to all Part 4 Directions and Remedial Orders. A Part 4 Direction or Remedial Order may be issued to a person whether or not the person is in Singapore. It may require the person to do an act in or outside Singapore. A Part 4 Direction must identify the subject material and subject statement in sufficient detail. A Part 4 Direction or Remedial Order remains in effect until it expires (if a date of expiry is specified), or it is set aside (in the case of a Part 4 Direction) or cancelled.
