The application shall not be considered if the
requirement of the Authority were not met.
ويف مجيع األحوال يعترب الطلب كأن مل يكن إذا مل يتم
.استيفاء ما طلبته اهليئة خالل املدة املقررة لذلك
3) Without prejudice to Article (22) of the Act, in the
presence of reasonable reasons, the Chief executive
shall not stick to periods stipulated in this Article.

4) In case the Authority decline the application, it shall
be justified, the Applicant shall not have the right to
apply to any telecom license for a period not
exceeding one year; with exemption to cases under the
Authority consideration.

Article 19: The Authority within the specified periods
stated in Article (18) shall take the following actions:
عليها يف هذه املادة إذا كانت هناك أسباب موضوعية
) من22( وذلك مع مراعاة حكم املادة،تربر ذلك
) يف حالة رفض اهليئة الطلب فيجب أن يكون رفضها4
وال حيق لصاحب الطلب التقدم بطلب جديد،مسببا
إىل اهليئة ألي نوع من أنواع تراخيص خدمات
،االتصاالت إال بعد انقضاء سنة من تاريخ رفض الطلب
إال يف احلاالت اليت تقدرها اهليئة
1. If the application meet the Authority`s
requirement, shall notify the applicant of its decision.
على اهليئة اختاذ اإلجراءات اآلتية خالل:)19( املادة
2. The Authority shall submit to the Minister its
decision approving the License application (Class
One & Two) as to:
) يف حالة رفض الطلب من قبل اهليئة جيب عليها1
A. In Case of Class One License: in case of the
Minister approval on the application, he shall
forward his proposal to issue a Royal Decree for
issuing the license within 2 weeks of the Authority
approval. In case of the Minister`s rejection. He shall
notify the Authority and the applicant of the
rejection of the application for reasons relating to the
national security of the Sultanate or to its
international relations within the specified period.
B.
In case of Class Two License: the Ministry
shall issue a decision to grant the license within two
weeks of the Authority approval or shall notify the
Authority and the applicant of the rejection of the
application for reasons relating to the national
security of the Sultanate or to its international
relations within the specified period.

.إخطار مقدم الطلب بقرارها
) ترفع اهليئة إىل الوزير موافقتها على طلب2
:الرتخيص من الفئتني األوىل والثانية الختاذ ما يلي
يف حالة موافقة:أ) بالنسبة إىل ترخيص الفئة األوىل
الوزيرعلى طلب الرتخيص يرفع مقرتحه باستصدار
مرسوم سلطاني خالل أسبوعني من تاريخ موافقة
ويف حالة عدم موافقته على طلب الرتخيص،اهليئة
جيب عليه إخطار طالب الرتخيص واهليئة برفض
الطلب ألسباب تتعلق باألمن الوطين للسلطنة أو
. وذلك خالل املدة املشار إليها،بعالقاتها الدولية
يصدر الوزير:ب)بالنسبة إىل ترخيص الفئة الثانية
قراره مبنح الرتخيص خالل أسبوعني من تاريخ
أو إخطار طالب الرتخيص واهليئة،موافقة اهليئة
برفض الطلب ألسباب تتعلق باألمن الوطين للسلطنة
. وذلك خالل املدة املشار إليها،أو بعالقاتها الدولية
