Unofficial translation MONGOLIA LAW December 3, 2015 Ulaanbaatar city CRIMINAL CODE /Revised/ GENERAL CLASS CHAPTER ONE COMMON GROUNDS Article 1.1. Purpose of the law 1. The purpose of this law is to protect human rights and freedoms, public and national interests, constitutional institutions, national and human security from criminal attacks and prevent crimes guaranteed by the Constitution of Mongolia. Article 1.2. Legal principles 1. The crime and the criminal responsibility for it shall be determined by this law. /This section was amended by the law of May 11, 2017/ 2. The criminal law will not be applied equally. 3. The law amending the Criminal Code, which newly criminalizes acts and omissions and establishes new types and amounts of criminal liability, shall be a component of this law. /This section was amended by the law of May 11, 2017/ 4. When interpreting the terms and concepts of this law, the definitions and norms specified in the laws of Mongolia and international agreements ratified by the laws of Mongolia shall be followed. 5. The act of administrative norms can be used to explain the terms and concepts of this law. Article 1.3. The principle of justice 1. Criminal liability is appropriate for the crime committed by the person or legal entity, the nature of the social danger of the crime, the amount, and the form of guilt. /This part was modified by the law of May 11, 2017/ 2. When considering a crime and sentencing a person, a person's origin, ethnicity, language, race, age, gender, social origin, status, wealth, occupation, position, religion, opinion, sexual and gender orientation, education, do not discriminate on the basis of disability. 3. Criminal liability shall be imposed on the person who committed the crime. Criminal responsibility cannot be applied to other people. /This section was amended by the law of May 11, 2017/ 4. The imposition of criminal liability on a person who committed a crime on behalf of a legal entity and for the benefit of a legal entity shall not be grounds for exempting the legal entity from criminal liability. /This section was amended by the law of May 11, 2017/ 5. One sentence shall be imposed for one crime. Article 1.4. The principle of guilt 1. A person found guilty by a court of committing a crime specified in this law shall be held criminally liable. /This section was amended by the law of May 11, 2017/ 2. No criminal liability shall be imposed if damage or harm specified in this law is caused without guilt. /This section was amended by the law of May 11, 2017/ 3. If the person who committed the crime was not aware of the social danger of his actions or inactions, or could not have been aware due to the circumstances of the case, could not or should not have known in advance the dangerous consequences for the society, it is considered that the harm was caused without guilt. /This part was modified by the law of May 11, 2017/ 4. Criminal liability will not be imposed for a person's opinions and beliefs. /The 3rd part was reorganized into the 3rd and 4th parts by the law of May 11, 2017/ Article 1.5. Penal Code shall apply in the territory of Mongolia 1. Persons who commit crimes in the territory of Mongolia shall be held criminally responsible by this law. /This section was amended by the law of May 11, 2017/ 2. Whoever commits a crime on a Mongolian ship or aircraft in the territory, water, or airspace of a diplomatic mission abroad belonging to the territory of Mongolia shall be subject to criminal liability under this law. /This section was amended by the law of May 11, 2017/
