OBJECTIVES AND PRINCIPLES Глава втора. ЦЕЛИ И ПРИНЦИПИ Чл. 4. (Изм. - ДВ, бр. 20 от 2021 г.) (1) Целите на този закон са: 1. да се създават необходимите условия за развитие на конкуренцията при предоставяне на електронни съобщителни мрежи и прилежащи съоръжения, включително ефективната конкуренция по отношение на инфраструктурата, както и при предоставяне на електронни съобщителни услуги и прилежащи услуги; 2. да се създават необходимите условия за развитие на свързаността и достъпа до мрежи с много голям капацитет, включително фиксирани, мобилни и безжични мрежи, както и тяхното използване от страна на всички граждани и стопански субекти; 3. да се подпомага развитието на вътрешния пазар, като се: а) отстраняват оставащите пречки и улесняват съгласуваните условия за инвестиции и предоставянето на електронни съобщителни мрежи и услуги, прилежащи съоръжения и прилежащи услуги; б) създават общи правила и предвидими регулаторни подходи; в) насърчават ефективното, ефикасното и координираното използване на радиочестотния спектър, отворените иновации, изграждането и развитието на общоевропейски мрежи, предоставянето, достъпността и оперативната съвместимост на общоевропейски услуги и свързаността от край до край и се осигуряват свързаност, широка достъпност и използване на мрежи с много голям капацитет; Art. 4. (Amend. – SG, 20/21) (1) The objectives of this Act are: 1. to provide relevant conditions for development of competition in provision of electronic communications networks and ancillary facilities, including effective competition in terms of infrastructure, as well as in the provision of electronic communications services and ancillary services; 2. to create the necessary conditions for the development of connectivity and access to very high-capacity networks, including fixed, mobile and wireless networks, as well as their use by all citizens and businesses; 3. to support the development of the internal market by: a) removing remaining barriers and facilitate agreed investment conditions and the provision of electronic communications networks and services, associated facilities and associated services; b) create common rules and predictable regulatory approaches; c) promote the efficient, effective and coordinated use of spectrum, open innovation, the construction and development of pan-European networks, the provision, accessibility and interoperability of pan-European services and end-to-end connectivity, and ensure connectivity, wide availability and use of networks with very high capacity; 4. to protect the interests of citizens by: a) providing connectivity, accessibility and use of very high-capacity networks, including fixed, mobile and wireless networks, as well as electronic communications services; b) providing the opportunity for maximum benefits in terms of choice, price and quality, based on effective competition; c) ensuring the security of networks and services; d) ensuring a high and general level of protection for end-users through the necessary rules, including conditions for the provision of clear information, by setting requirements for transparency of tariffs and conditions for the use of public electronic communications services and the use of applications and services of their choice; e) taking into account the needs of specific social groups, in particular people with disabilities, the elderly and people with special social needs, as well as the choice and equal access for people with disabilities. (2) Electronic communications managing and regulatory authorities shall undertake all reasonable measures for achieving the objectives, set out in Para 1, in the scope and in terms, adequate to the respective objective, where: 1. take into consideration as much as possible the need in technological neutrality; 2. promote regulatory predictability by: a) ensuring a coherent regulatory approach with appropriate review deadlines, and b) cooperation between the Member States of the European Union, the Body of European Regulators for Electronic Communications, the Radio Spectrum Policy Group and the European Commission; 3. implement policies, aimed at promoting freedom of expression and information, cultural and linguistic diversity, and media pluralism; 4. ensure that, in similar circumstances, there is no discrimination in Източник: Правно-информационни системи "Сиела" 11.04.2023 г.
