Definitions.—In this Act, unless the context otherwise indicates— “Appeal Tribunal” means the Appeal Tribunal established by section 3; [Definition of “Appeal Tribunal” inserted by s. 1 (a) of Act No. 3 of 2009.] “Board” means the Film and Publication Board, established by section 3; “certificate”, in relation to a film, means the certificate referred to in section 18, issued in respect of the classification of a film; “chief executive officer” means the chief executive officer of the Board referred to in section 4 (1) (c); [Definition of “chief executive officer” substituted by s. 1 (b) of Act No. 3 of 2009.] Wording of Sections “child pornography” includes any image, however created, or any description of a person, real or simulated, who is or who is depicted, made to appear, look like, represented or described as being, under the age of 18 years— (a) (b) (c) engaged in sexual conduct; participating in, or assisting another person to participate in, sexual conduct; or showing or describing the body, or parts of the body, of such a person in a manner or in circumstances which, within context, amounts to sexual exploitation, or in such a manner that it is capable of being used for the purposes of sexual exploitation; [Definition of “child pornography” inserted by s. 1 (a) of Act No. 34 of 1999, amended by s. 1 (a) of Act No. 18 of 2004 and substituted by s. 1 (c) of Act No. 3 of 2009.] Wording of Sections “classification”, means any decision by the Board in terms of this Act;
