•28th September, 1936 T H E PALESTINE GAZETTE 1009 (2) N o legal proceedings, whether civil or criminal, shall be taken against any such woman for taking away or being found i n possession of any such wearing apparel as was necessary to enable her to leave such premises or brothel. 172.—(1) A Magistrate may issue a search warrant authorising the person named i n the warrant to make search i n any house or premises if he has reason to believe that— Search warrant. ( a ) such premises are being used for any purpose contrary to the provisions of this chapter; or (6) any person is detained, concealed or present therein w i t h regard to w h o m any offence under this chapter is believed to have been committed or to be i n contemplation. (2) I f upon such search any person is found upon the premises w i t h regard to whom an offence under this chapter is believed to have been committed or to be contemplated, such person may be detained by the police i n a place of safety pending enquiries, or may by order of the Magistrate be delivered up to his or her parents or guardians or otherwise dealt w i t h as circumstances may permit or require. (3) T h e provisions of sections 18 to 22 inclusive of the Arrest of Offenders and Searches Ordinance, 1924, shall apply to warrants issued under this section, but the provisions of section 17 thereof shall not apply. (4) F o r the purpose of this section the term "premises" shall be deemed to include any ship, boat, railway train, carriage or other vehicle. (5) A woman shall be deemed to be unlawfully detained for immoral purposes if she is so detained for the purpose of having unlawful sexual intercourse w i t h any m a n , whether any particular man or generally, and : (a) either is under the age of sixteen years; or ( b ) i f she is of or over the age of sixteen years and under the age of eighteen years, is so detained against her w i l l or against the w i l l of her father or mother or of any person having the lawful care or charge of her ; or (c) if she is of or over the age of eighteen detained against her w i l l . years and is so 173. E v e r y woman who is proved to have for the purpose of gain exercised control, direction or influence over the movements of a prostitute i n such a manner as to show that she is aiding, abetting or compelling her prostitution w i t h any person, or generally, is guilty of a misdemeanour. A n y person who conspires with another to induce any female, by means of any false pretence or other fraudulent means, to permit any person to have unlawful sexual intercourse w i t h her, is guilty of a misdemeanour. A n y person who, w i t h intent to procure miscarriage of a woman, whether she is or is not w i t h child, unlawfully administers to her or causes her to take any poison or other noxious t h i n g , or uses any force of any k i n d , or uses any other means whatever, is guilty of a felony, and is liable to imprisonment for fourteen years.
