A p e r s o n w h o h a c k s into a n y c o m p u t e r s y s t e m , or introduces or spreads a virus or malicious software into a computer s y s t e m or n e t w o r k , c o m m i t s an offence and is l i a b l e , u p o n conviction, to a fine not exceeding five hundred thousand penalty units or to imprisonment for a period not exceeding five years, or to both. Denial of service attacks 1 0 4 . A person w h o renders a computer system incapable of providing normal services to its legitimate users commits an offence and is liable, upon conviction, to a fine not exceeding nine hundred thousand penalty units or to imprisonment for a period not exceeding ten years, or to both. Spamming 105. A p e r s o n w h o t r a n s m i t s a n y u n s o l i c i t e d e l e c t r o n i c information to another person for purposes of illegal trade or commerce or other illegal activity, commits an offence and is liable, upon conviction, to a fine not exceeding two hundred thousand penalty units or to imprisonment for a period not exceeding t w o years, or to both. Prohibition of illegal trade and commerce 1 0 6 . (1) A person shall not use the internet as a m e d i u m for any illegal activity or trade, fraudulent transaction or to procure any internet-related fraud. (2) A p e r s o n w h o c o n t r a v e n e s s u b s e c t i o n (1) c o m m i t s an offence and is liable, upon conviction, to imprisonment for a period not exceeding ten years. Application of offences under this Act 1 0 7 . (1) Subject to subsection (2), this Act shall have effect in relation to any p e r s o n , w h a t e v e r t h e p e r s o n ' s n a t i o n a l i t y or citizenship, outside as well as within Zambia, and where an offence under this Act is committed by a person in any place outside Zambia, the person shall be dealt with as if the offence had been committed within Zambia. (2) For the purposes of subsection (1), this Act shall apply if, for the offence in q u e s t i o n — (a) the accused was in Zambia at the material time; (b) the computer, program or data w a s in Z a m b i a at the material time; or (c) t h e d a m a g e o c c u r r e d within Z a m b i a w h e t h e r or not paragraph (a) or (b) applies.
