Ar cle 224 The crea on or aliena on of a real right in movable property shall take e ect upon delivery, unless otherwise provided by law. Ar cle 225 The crea on, altera on, aliena on, or ex nguishment of the real rights in vessels, aircra s, motor vehicles, and the like, that have not been registered is not e ec ve against a bona de third person. Ar cle 226 Where a right holder is already in possession of a movable property before a real right in the movable property is created or alienated, the real right in the movable property becomes e ec ve at the me when the civil juris c act is e ected. Ar cle 227 Where a third person is in possession of a movable property before a real right in the movable property is created or alienated, the person obligated to deliver the movable property may transfer his right to res tu on against the third person as subs tute for delivery. Ar cle 228 Where, upon aliena on of a real right in movable property, the par es agree that the transferor con nues to be in possession of the movable property, the real right in the movable property becomes e ec ve at the me when such an agreement enters into e ect. Sec on 3 Other Rules Ar cle 229 Where a real right is created, altered, alienated, or ex nguished as a result of a legal document issued by the people’s court or an arbitra on ins tu on, or based on an expropria on decision made by the people’s government, the crea on, altera on, aliena on, or ex nguishment of the real right becomes e ec ve at the me when the legal document or expropria on decision enters into e ect. Ar cle 230 Where a real right is acquired through succession, the real right as inherited becomes e ec ve at the me when the succession opens. Ar cle 231 Where a real right is created or ex nguished as a result of a de facto act such as lawful construc on or demoli on of a house, the crea on or ex nguishment of the real right becomes e ec ve when the de facto act is accomplished. Ar cle 232 Where disposi on of a real right in immovable property as provided in this Sec on is required by law to be registered, the disposi on of the real right, if not so registered, is not e ec ve. Chapter III Protec on of Real Rights Ar cle 233 Where a real right is infringed upon, the right holder may have the problem solved by means of se lement, media on, arbitra on, li ga on, and the like. Ar cle 234 Where a dispute arises over the a ribu on or contents of a real right, an interested person may request for con rma on of the right. Ar cle 235 Where an immovable or movable property is possessed by a person not en tled to do so, the right holder may request for res tu on. Ar cle 236 Where there is a nuisance or a poten al nuisance against a real right, the right holder may request for removal of the nuisance or elimina on of the danger.
