Chapter XV Contracts for Financing Lease Ar cle 735 A contract for nancing lease is a contract under which a lessee selects a leased object and its seller, and a lessor purchases the leased object from the selected seller and provides it to the lessee for use, who pays the rent in return. Where the lessee exercises such a right, the lessor shall render assistance. Ar cle 742 A lessee’s exercise of the right to claim against the seller shall not a ect his performance of the obliga on to pay the rent. However, where a lessee has relied upon the lessor's exper se in selec ng the leased object or the lessor has intervened with the selec on of the leased object, the lessee may request reduc on or exemp on of the rent accordingly. Ar cle 743 Where any of the following circumstances occurs, which causes the failure of the lessee to exercise the right to claim against the seller, the lessee has the right to request the lessor to bear corresponding liability: (1) the lessor clearly knows that the leased object has quality defects but fails to no fy the lessee; or (2) when the lessee exercises the right to claim, the lessor fails to provide necessary assistance in a mely manner. Where a right to claim against the seller may only be exercised by the lessor but the lessor fails to exercise such right owing to his indolent, thus causing loss to the lessee, the lessee has the right to request the lessor to bear the liability for compensa on.
