28th September, 1936 (b) THE PALESTINE GAZETTE the continuous absence of the former husband or wife, as the case may be, at the time of the subsequent marriage, for the space of seven years then last past without knowledge or information that such former husband or wife was alive w i t h i n that period ; o r (c) that the law governing the personal status of the husband both at the date of the first and at the date of the subsequent marriage allowed h i m to have more than one wife. r 182. A n y person who :— ( a ) celebrates or is a party to the celebration of a marriage w i t h knowledge that no licence has been issued by a com­ petent authority for such celebration; or (b) Celebration of certain mar­ riages, etc., punishable. marries, celebrates or i n any capacity assists at the celebration of a marriage of a female who is under the age of fifteen }‫־׳‬ears completed; or (c) issues a licence for the celebration of the marriage of a female who is under the age of fifteen years completed; or (d) issues a licence for the celebration of the marriage of a female who is under the age of seventeen years completed, without having first ascertained that the parents or guardians of such female have consented thereto; or (e) issues a licence for a marriage knowing or having reason to believe that either of the parties is a married person and that a second marriage would be an offence w i t h i n the meaning of section 181 of this Code, is guilty of a misdemeanour and is liable to imprisonment for six months. 183. It shall be a good defence to a charge brought under paragraph (b) or (c) of section 182 of this Code to prove : — Defences in certain cases. ( a ) that the marriage took place with the consent of any living parents or guardians of the female, and ( b ) that at the time of the marriage the female had reached puberty, and ( c ) that at the time of the marriage a certificate (which cer­ tificate shall be deemed to be a certificate w i t h i n the meaning of section 12 of the Medical Practitioners Ordinance, 1928) had been produced from a medical practitioner licensed to practise under the Medical Practitioners Ordinance, 1928, that no physical i l l effects would be likely to follow the consummation of the marriage by the female. 184. A n y person who unlawfully abandons or exposes any child under the age of two years, whereby the life of the child is endangered or its health has been or is likely to be permanently injured, is guilty of a felony and is liable to imprisonment for five years; Exposure of child. 185. A n y person w h o , being the parent or guardian or other person having the lawful care or charge of any child of tender years and unable to provide for itself, refuses or neglects (being able to do so) to provide sufficient food, clothes, bedding and other neces­ saries for such child, so as thereby to injure the health of such child, is guilty of a misdemeanour. A n y person who being the parent, guardian or other person having the lawful care or charge of a child under the age of twelve Desertion of children.
