28th September, 1936 T H E PALESTINE 1013 GAZETTE (3) A n y person who keeps a common gaming house is guilty of a misdemeanour. (4) A n y person other than the persons mentioned i n sub-section (1) hereof who is found i n a common gaming house shall be deemed, unless the contrary is proved, to be there for the purpose of unlawfully gaming and is guilty of a misdemeanour and is liable to a fine of five pounds for the first offence, and for each subsequent offence to a fine of ten pounds or imprisonment for three months, or to both such penalties. (5) A n y device, machine or thing used or apparently used or intended to be used for the purpose of unlawful gaming found i n or upon any house, room or place kept or alleged to be kept or used for the purpose of unlawful gaming, may be seized by a police officer and upon the trial of any person i n connection w i t h the keeping or use of such house, room or place, contrary to the provisions of this Code, the court may make such order as to the forfeiture, destruction or return of any device, machine or thing as the court seems just. 191. —(1) A n y person who opens, keeps or uses any place for carrying on a lottery of any kind whatever, is guilty of a misdemeanour. Lotteries, (2) A n y person who prints or publishes, or causes to be printed or published, any advertisement or other notice of or relating to any lottery, or of or relating to the sale of any ticket or chance or of any share in any ticket or chance i n any lottery or sells or offers for sale any such ticket or chance, is guilty of a misdemeanour and is liable to a fine of fifty pounds. (3) I n this section the term " l o t t e r y " includes any scheme or device for the sale, gift, disposal or distribution of any property depending upon or to be determined by lot or chance, whether by the throwing or casting of dice, or by the drawing of tickets, cards, lots, numbers or figures, or by means of a wheel or trained animal, or otherwise howsoever. (4) A prosecution for any offence under this section shall not be instituted except by or w i t h the consent of the Attorney-General. (5) T h e provisions of this section shall not apply to any lottery permission to hold which has previously been obtained from the H i g h Commissioner. 192. A n y person who appears, acts or behaves as master or mistress, or as the person having the care or management of any such house, room, set of rooms or place as is mentioned i n section 190 or 191 of this Code is to be taken to be the keeper thereof, whether he is or is not the real keeper. 193. Any person who : — Keeper of prem i s e s d e f i n e d • Idle and disorderly persons, (a) being a common prostitute, behaves i n a disorderly or indecent manner i n any public place; (b) is found wandering or placing himself i n any public place to beg or gather alms, whether by the exposure of wounds or deformation or by any other means whatsoever, or causing, .•' procuring or encouraging any child under the age of sixteen years so to do; ( c ) is found going about as a gatherer or collector of alms or endeavouring to procure charitable contributions of any nature or k i n d under any false or fraudulent pretence; ( d ) i n any public place conducts himself i n a manner likely to cause a breach of the peace ; begging, etc.
