offences in relation to information technology.
Article 7
Responsibilities for State administration of information technology
1.
The Government shall assume unified State administration of information technology.
2.
The Ministry of Posts and Telematics shall be responsible to the Government for presiding over and
co-ordinating with ministries and relevant ministerial equivalent bodies in undertaking State
administration of information technology.
3.
Ministries and ministerial equivalent bodies shall, depending on their duties and powers, be
responsible to preside over and co-ordinate with the Ministry of Posts and Telematics in undertaking
State administration of information technology as assigned by the Government.
4.
People's committees of provinces and cities under central authority shall, depending on their duties
and powers, undertake State administration of information technology in their respective localities.
5.
The implementation of information technology application for operations of State bodies shall be
organized in accordance with regulations of the Government.
Article 8

Rights of organizations and individuals engaged in information technology application and
development activities
Organizations and individuals engaged in information technology application activities shall have the
following rights:
(a)
To search, exchange and use information in the network environment, except for information
with the contents specified in article 12.2 of this Law;
(b)
To request restoration of their information or restoration of the ability to access their
information sources in the case where such information does not breach article 12.2 of this
Law;
(c)
To request the authorized State body to resolve in accordance with law in the case where [the
request for] restoration of their information or restoration of the ability to access such
information sources is refused;
(d)
To take delivery to contact addresses available in the network environment upon agreement of
the owners of such contact addresses;
(dd)
To refuse to supply or receive products or services which are contrary to the law in the network
environment and to be responsible for such refusal.
Organizations and individuals engaged in information technology development shall have the
following rights:
(a)
To research and develop information technology products;
(b)
To produce information technology products; to digitalize, maintain and increase the value of
information resources.
