Act No. 32, 2008 LIQUOR PRODUCTS AMENDMENT ACT. 2008 (d) by the substitution for subsection (5) of the following subsection: " ( 5 ) (a) A m e m b e r [or an alternate m e m b e r ] of the board shall vacate [his] office if he or s h e — (i) [if he b e c o m e s subject to any disability m e n t i o n e d in] b e c o m e s disqualified in terms of subsection (3); (ii) [if h e ] b e c o m e s of unsound mind; (iii) [if, in the c a s e of a m e m b e r , he] h a s been absent from m o r e than two consecutive meetings of the board without the leave of the [ c h a i r m a n ] chairperson [(iv) if, in the case of a m e m b e r o r an a l t e r n a t e m e m b e r n o m i n a t e d by a b o d y specified in s u b s e c t i o n (2)(a)(i), (ii) or (iv), the body c o n c e r n e d notifies the D i r e c t o r - G e n e r a l in w r i t i n g t h a t such m e m b e r or alternate m e m b e r shall no l o n g e r s e r v e o n the board as n o m i n e e of that b o d y ] . (b) [ T h e ] Subject to the P r o m o t i o n of A d m i n i s t r a t i v e Justice Act, 2 0 0 0 (Act N o . 3 of 2000), the Minister may at any time r e m o v e a m e m b e r [or an alternate m e m b e r ] of the board from [his] office if in the opinion of the Minister, sound reasons exist for doing s o . " ; (e) by the substitution for subsection (6) of the following subsection: "(6) [(a) T h e m e m b e r referred to in s u b s e c t i o n (2)(a)(v) shall b e the c h a i r m a n of the b o a r d . ] (b) T h e m e m b e r s of the board shall at the first meeting of the board, and thereafter w h e n e v e r necessary, elect a [ v i c e - c h a i r m a n ] d e p u t y chairperson from [ a m o n g the m e m b e r s referred to in s u b s e c t i o n (2) (a)(i), (ii), (iii) a n d (iv)] a m o n g s t t h e m s e l v e s . (c) If both the [ c h a i r m a n ] chairperson and the [ v i c e - c h a i r m a n ] deputy chairperson are absent from a m e e t i n g of the board, the m e m b e r s present shall from [ a m o n g their n u m b e r ] a m o n g s t t h e m s e l v e s elect a [person] m e m b e r to preside at [that] such m e e t i n g . " : and by the substitution for subsection 9 of the following subsection: " ( 9 ) [There m a y be paid to a m e m b e r and a n a l t e r n a t e m e m b e r of the b o a r d a n d ] A m e m b e r of the board and a m e m b e r of a c o m m i t t e e referred to in subsection (8) w h o are not in the full-time e m p l o y m e n t of the State, shall be paid from the funds of the board such a l l o w a n c e s as the Minister may. with the c o n c u r r e n c e of the Minister of F i n a n c e , d e t e r m i n e in general or in any particular c a s e . " . (f) A m e n d m e n t of section 4 of A c t 6 0 o f 1989 3. Section 4 of the principal Act is hereby a m e n d e d by the substitution for subsection (1) of the following subsection: " ( 1 ) N o person shall sell or produce for sale any p r o d u c t — (a) with an alcohol content of more than one per cent for drinking p u r p o s e s [,] ^ or (b) including but not limited to a p o w d e r form, w h i c h , c o m b i n e d with any substance or liquid, will h a v e an alcohol content of m o r e than one per cent and is intended for drinking purposes, unless that product is a liquor p r o d u c t . " . A m e n d m e n t of section 5 of A c t 6 0 o f 1989 4. Section 5 of the principal Act is hereby a m e n d e d by the substitution for subsection (1) of the following subsection: "(1) W i n e shall be p r o d u c e d — (a) [be p r o d u c e d f r o m fresh] from grapes of a prescribed cultivar [that are in s u c h a c o n d i t i o n that, after h a v i n g b e e n p r e s s e d , alcoholic f e r m e n t a t i o n c a n o c c u r in the u n d i l u t e d j u i c e thereof]; (b) [be p r o d u c e d ] b y — (i) the alcoholic fermentation, in a c c o r d a n c e with generally a c c e p t e d cellar practices, of the juice of [such fresh] grapes c o n t e m p l a t e d in paragraph (a) or the reconstituted juice obtained from a c o n c e n t r a t e of the juice of such grapes or of a mixture of such juice and such reconstituted juice;
