Article 163 A penalty of imprisonment for a term not exceeding five years shall apply to any public officer who arrests a person, imprisons or seizes him except in those cases authorized by law, or orders a penalty for a convicted person that is more severe than stipulated by law or a penalty for which the perpetrator was not convicted. Article 164 A penalty of imprisonment for a term not exceeding three years and a fine not exceeding ten thousand Qatari Riyals (10.000QR) or one of the two penalties shall apply to any public officer who infringes the provisions of the law with the intention to achieve one of the following purposes: 1- To protect a person from serving or executing his due sentence by reducing the imposed penalty or delaying its execution. 2- To protect any asset from confiscation, seizure, or any restriction set by the law on the said asset, or to delay its confiscation or seizure, or to impose or execute any restriction on it. Article 159 (Amended By Law 8/2010) ‫ﻛﻝ ﻣﻭﻅﻑ ﻋﺎﻡ ﺍﺳﺗﻌﻣﻝ ﺍﻟﻘﻭﺓ ﺃﻭ ﺍﻟﺗﻬﺩﻳﺩ ﻣﻊ ﻣﺗﻬﻡ ﺃﻭ ﺷﺎﻫﺩ ﺃﻭ ﺧﺑﻳﺭ ﺃﻭ ﺃﻣﺭ ﺑﺫﻟﻙ ﻟﺣﻣﻠﻪ ﻋﻠﻰ ﺍﻻﻋﺗﺭﺍﻑ ﺑﺟﺭﻳﻣﺔ ﺃﻭ ﻋﻠﻰ ﺍﻹﺩﻻء ﺑﺄﻗﻭﺍﻝ ﺃﻭ ﻣﻌﻠﻭﻣﺎﺕ ﺑﺷﺄﻧﻬﺎ ﺃﻭ ﻟﻛﺗﻣﺎﻥ‬ ٬‫ﻳﻌﺎﻗﺏ ﺑﺎﻟﺣﺑﺱ ﻣﺩﺓ ﻻ ﺗﺟﺎﻭﺯ ﺧﻣﺱ ﺳﻧﻭﺍﺕ‬ ‫ﺃﻣﺭ ﻣﻥ ﻫﺫﺍ ﺍﻷﻣﻭﺭ‬. ‫ﻋﻭﻗﺏ ﺍﻟﺟﺎﻧﻲ ﺑﺎﻟﺣﺑﺱ ﻣﺩﺓ ﻻ ﺗﺟﺎﻭﺯ ﻋﺷﺭ ﺳﻧﻭﺍﺕ‬ ٬‫ﻭﺇﺫﺍ ﺗﺭﺗﺏ ﻋﻠﻰ ﻓﻌﻝ ﺍﻟﻣﻭﻅﻑ ﺇﺻﺎﺑﺔ ﺍﻟﻣﺟﻧﻲ ﻋﻠﻳﻪ ﺑﻌﺎﻫﺔ ﻣﺳﺗﺩﻳﻣﺔ‬. ‫ﺃﻭ ﺍﻟﺣﺑﺱ ﺍﻟﻣﺅﺑﺩ‬ ٬‫ﻋﻭﻗﺏ ﺍﻟﺟﺎﻧﻲ ﺑﺎﻹﻋﺩﺍﻡ‬ ٬‫ﻭﺇﺫﺍ ﺗﺭﺗﺏ ﻋﻠﻰ ﻫﺫﺍ ﺍﻟﻔﻌﻝ ﻭﻓﺎﺓ ﺍﻟﻣﺟﻧﻲ ﻋﻠﻳﻪ‬.. Article 165 The perpetrator, in addition to the penalties stipulated for offences in this Chapter, may be sentenced to exclusion from public office. Article 159 - BIS (Added By: Law 8 / 2010) ‫ﻣﻊ ��ﺧﺹ ﻣﺎ‬ ٬‫ﺍﺳﺗﻌﻣﻝ ﺍﻟﺗﻌﺫﻳﺏ ﺃﻭ ﺣﺭﺽ ﺃﻭ ﻭﺍﻓﻕ ﻋﻠﻳﻪ ﺃﻭ ﺳﻛﺕ ﻋﻧﻪ‬ ٬‫ﺃﻭ ﺃﻱ ﺷﺧﺹ ﺁﺧﺭ ﻳﺗﺻﺭﻑ ﺑﺻﻔﺗﻪ ﺍﻟﺭﺳﻣﻳﺔ‬ ٬‫ﻛﻝ ﻣﻭﻅﻑ ﻋﺎﻡ‬ ٬‫ﻳﻌﺎﻗﺏ ﺑﺎﻟﺣﺑﺱ ﻣﺩﺓ ﻻ ﺗﺟﺎﻭﺯ ﺧﻣﺱ ﺳﻧﻭﺍﺕ‬. ‫ﻋﻭﻗﺏ ﺍﻟﺟﺎﻧﻲ ﺑﺎﻟﺣﺑﺱ ﻣﺩﺓ ﻻ ﺗﺟﺎﻭﺯ ﻋﺷﺭ ﺳﻧﻭﺍﺕ‬ ٬‫ﻭﺇﺫﺍ ﺗﺭﺗﺏ ﻋﻠﻰ ﺍﻟﺗﻌﺫﻳﺏ ﺇﺻﺎﺑﺔ ﺍﻟﻣﺟﻧﻲ ﻋﻠﻳﻪ ﺑﻌﺎﻫﺔ ﻣﺳﺗﺩﻳﻣﺔ‬. ‫ﺇﺫﺍ ﺗﺭﺗﺏ ﻋﻠﻰ ﺍﻟﺗﻌﺫﻳﺏ ﻭﻓﺎﺓ ﺍﻟﻣﺟﻧﻲ ﻋﻠﻳﻪ‬ ٬‫ﻭﺗﻛﻭﻥ ﺍﻟﻌﻘﻭﺑﺔ ﺍﻹﻋﺩﺍﻡ ﺃﻭ ﺍﻟﺣﺑﺱ ﺍﻟﻣﺅﺑﺩ‬. ‫ﺃﻭ ﻳﺷﺗﺑﻪ‬ ٬‫ﺃﻭ ﻣﻌﺎﻗﺑﺗﻪ ﻋﻠﻰ ﻋﻣﻝ ﺍﺭﺗﻛﺑﻪ‬ ٬‫ﻋﻠﻰ ﻣﻌﻠﻭﻣﺎﺕ ﺃﻭ ﻋﻠﻰ ﺍﻋﺗﺭﺍﻑ‬ ٬‫ﺃﻭ ﻣﻥ ﻏﻳﺭﻩ‬ ٬‫ﻳُﻠﺣﻕ ﻋﻣﺩ ًﺍ ﺑﺷﺧﺹ ﻣﺎ ﻷﻏﺭﺍﺽ ﺍﻟﺣﺻﻭﻝ ﻣﻧﻪ‬ ٬ً‫ﺟﺳﺩﻳﺎً ﻛﺎﻥ ﺃﻡ ﻣﻌﻧﻭﻳﺎ‬ ٬‫ﻭﻳﻌﺩ ﺗﻌﺫﻳﺑﺎً ﺃﻱ ﻋﻣﻝ ﻳﻧﺗﺞ ﻋﻧﻪ ﺃﻟﻡ ﺃﻭ ﻣﻌﺎﻧﺎﺓ ﺷﺩﻳﺩﻳﻥ‬ ‫ﻭﻻ ﻳﺷﻣﻝ ﺫﻟﻙ ﺍﻷﻟﻡ ﺃﻭ ﺍﻟﻣﻌﺎﻧﺎﺓ ﺍﻟﻧﺎﺷﺊ ﻓﻘﻁ ﻋﻥ‬. ‫ﺃﻭ ﻋﻧﺩﻣﺎ ﻳﻠﺣﻕ ﻣﺛﻝ ﻫﺫﺍ ﺍﻷﻟﻡ ﺃﻭ ﺍﻟﻌﺫﺍﺏ ﻟﺳﺑﺏ ﻳﻘﻭﻡ ﻋﻠﻰ ﺍﻟﺗﻣﻳﻳﺯ ﺃﻳﺎً ﻛﺎﻥ ﻧﻭﻋﻪ‬ ٬‫ﻫﻭ ﺃﻭ ﺷﺧﺹ ﺁﺧﺭ ﺃﻭ ﺗﺧﻭﻳﻔﻪ ﺃﻭ ﺇﺭﻏﺎﻣﻪ ﻫﻭ ﺃﻭ ﺃﻱ ﺷﺧﺹ ﺁﺧﺭ‬ ٬‫ﻓﻲ ﺃﻧﻪ ﻗﺩ ﺍﺭﺗﻛﺑﻪ‬ ‫ﻋﻘﻭﺑﺎﺕ ﻗﺎﻧﻭﻧﻳﺔ ﺃﻭ ﺍﻟﻣﻼﺯﻡ ﻟﻬﺫﻩ ﺍﻟﻌﻘﻭﺑﺎﺕ ﺃﻭ ﺍﻟﺫﻱ ﻳﻛﻭﻥ ﻧﺗﻳﺟﺔ ﻋﺭﺿﻳﺔ ﻟﻬﺎ‬. Chapter Four Insulting, Assaulting, and Threatening Public Officers Article 166 A penalty for a term not exceeding six months and a fine not exceeding three thousand Qatari Riyals (3000QR) or one of the two penalties shall apply to any person who humiliates by word, sign or menace a public officer during the exercise of his office or due to the said exercise.
