Adultery and Crimes of Honour
Article 279
Whoever copulates with a female without her consent whether coercively, under duress or by ruse shall be sentenced to death or to life imprisonment.
The sentence shall be capital punishment if the perpetrator from the ascendants of the victim, or the guardian, or those undertaking the brining up or looking
after the victim, or is a person having authority thereupon, or the servant thereof or the servant of the aforesaid in this Article.
Article 280
Whoever copulates with a female without compulsion, duress or ruse knowing that she is of diminished capacity or under sixteen years of age shall be
punished with life imprisonment.
Capital punishment shall apply if the offender is one of those previously mentioned in the second Paragraph of the preceding Article.
Article 281
Whoever copulates with a female over sixteen without compulsion, duress or ruse shall be punished with imprisonment for a term up to seven years.
The same penalty shall also be imposed on the female for her consent. The offender shall be sentenced to life imprisonment or to a prison term up to fifteen
years if he is one of those previously mentioned in the second paragraph of Article 279 of the present Law.
Article 282
Whoever copulates with a female over sixteen without compulsion, duress or ruse knowing that he is prohibited to marry her for permanent or temporary
reasons shall be punished with imprisonment for a term not exceeding fifteen years shall apply to any person.
The same penalty shall apply to a female who accepts such copulation knowing that it is prohibited.
The offender shall be liable to life imprisonment or a prison term not exceeding fifteen years if he is one of the previously mentioned in the second Paragraph
of Article 279 of the present Law.
Article 283
Whoever copulates with a male without any consent whether coercively, under duress or by ruse shall be punished with imprisonment for a term up to
fifteen years.
The death sentence shall be imposed if the offender is one of the previously mentioned in the second Paragraph of Article 279 of the present Law.
