the lot of land occupied by the building, structure, and auxiliary facili es thereof shall be disposed of concomitantly. Ar cle 358 Where a right to use a lot of land for construc on purposes needs to be taken back prior to expira on of its term for public interest purposes, compensa on shall be paid for the houses and other immovable property on the land according to the provisions of Ar cle 243 of this Code, and the por on of the unused transfer fee shall be refunded. Ar cle 359 The right to use a lot of land for construc on of residen al buildings is automa cally renewed upon expira on of the term. The payment, reduc on, or exemp on of the renewal fees shall be dealt with in accordance with the provisions of laws and administra ve regula ons. The renewal of the right to use a lot of land for construc on of buildings other than residences, upon expira on of the term, shall be dealt with in accordance with the provisions of the laws. The ownership of the buildings and other immovable property on such lot of land shall be determined in accordance with the agreement, or, where there is no agreement or the agreement is unclear, in accordance with the provisions of laws and administra ve regula ons . Ar cle 360 Where a right to use a lot of land for construc on purposes is ex nguished, the transferor of the right shall deregister the right in a mely manner. The registra on authority shall withdraw the tle cer cate thereof. Ar cle 361 The using of a lot of collec vely-owned land for construc on purposes shall be dealt with in accordance with the provisions of the laws on land administra on. Chapter XIII Right to Use a House Site Ar cle 362 A person who has the right to use a house site is en tled to possess and use the lot of land owned by the collec ve, and to u lize such lot of land to build a dwelling and auxiliary facili es in accordance with law. Ar cle 363 The acquisi on, exercise, and transfer of the right to use a house site are governed by the laws on land administra on and the relevant regula ons of the State. Ar cle 364 Where a house site is destroyed due to natural disasters or for other reasons, the right to use the house site is ex nguished. A new house site shall be allocated in accordance with law to the villagers who have lost their house site. Ar cle 365 Where a registered right to use a house site is transferred or ex nguished, registra on of the change or deregistra on of the right shall be made in a mely manner. Chapter XIV Right of Habita on Ar cle 366 A person with a right of habita on is en tled to the right to usufruct of possessing and using another person’s dwelling as agreed in the contract, so as to meet his needs of habita on. Ar cle 367 To create a right of habita on, the par es shall enter into a contract on such a right in wri ng.
