ЯĩĖ˝◦Б ơ SECTION 1 ŁũČĠс ŁũþН¹ е ₣ е ĕЊ₣ŁũĠİš е₣ЮŢŎŠН₤şĤĠс ARREST, DETENTION AND UNLAWFUL CONFINEMENT ŌŪ″ Ựư.- Ġ◦ČĠс þН¹ е е₣ ĕЊ₣Ġİš ₣ е ЮŢŎŠН₤şĤĠс Article 253: Arrest, detention and unlawful confinement បុគគលែដលចប់ ែដលឃុឃ ំ ង ំ ឬែដលបងខង ំ បុគគលេផ ង Anyone who, without judicial authorisation, or who unlawfully arrests, detains េទៀត េ យគមនបញជពី ជញធរ្រសបចបប់ ឬេ្រកពក ី រណី or unlawfully confines another person shall be ែដលចបប់អនុញញត ្រតូវផ្ដនទេទស៖ punishable by imprisonment: ១- ក់ពនធនគរពី ១ (មួយ) ឆន ំ េទ ៣ (បី) ឆន ំ េបី ករចប់ ករឃុ ឃ ំ ង ំ ឬករបងខង ំ ខ្លួនមនរយៈេពលតច ិ ជង ៤៨ (ែសសប ិ ្របំបី) េម៉ង។ ២- ក់ពនធនគរពី ៣ (បី) ឆន ំ េទ ៥ (្របំ) ឆន ំ េបក ំ ង ំ ឬ ករបងខង ំ ខ្លួនមនរយៈេពលចប់ពី ី រចប់ ករឃុឃ ៤៨ (ែសសប ិ ្របំបី) េម៉ង ដល់តច ិ ជង ១ (មួយ) ែខ។ (1) from one to three years if the arrest, detention or unlawful confinement is for less than forty eight hours; (2) from three to five years if the arrest, detention or unlawful confinement is for more than forty eight hours but less than one month; Bunleng Cheung ៣- ក់ពនធនគរពី ៥ (្របំ) ឆន ំ េទ ១០ (ដប់) ឆន ំ េបីករចប់ ករឃុឃ ំ ង ំ ឬករបងខង ំ ខ្លួនមនរយៈេពលេសមី ឬ េលីសពី ១ (មួយ) ែខ។ (3) from five to ten years if the arrest, detention or unlawful confinement is for one month or more. Article 254: Aggravating circumstances ŌŪ″ Ự̉.- ⅜□ĕ◦ņĞĕЮс Ĉ₤ បុគគលែដលចប់ ែដលឃុឃ ំ ង ំ ឬែដលបងខង ំ បុគគលេផ ង Anyone who, without judicial authorisation, or who unlawfully arrests, detains េទៀត េ យគមនបញជពី ជញធរ្រសបចបប់ ឬេ្រកពីករណី or unlawfully confines another person shall be ែដលចបប់អនុញញត ្រតូវផ្ដនទេទស ក់ពនធនគរ ពី ១៥ punishable by imprisonment from fifteen to thirty (ដប់្របំ) ឆន ំ េទ ៣០ ( មសិប) ឆន ំ កនុងករណីដូចខង years in the following cases: េ្រកម៖ ឱយ ១-េ យមនទរុណកមម ឬអំេពីេឃរេឃ។ (1) the arrest, detention or unlawful confinement is accompanied by torture or acts of cruelty; ២-ប ្ល ប់េ យគមនបំណងនឹងេធ្វី (2) the arrest, detention or unlawful confinement is followed by the unintentional death of the person; ៣-្រប្រពឹត្ដកុ នងេគលេ ជំរតយក្រទពយសមបត្ដ ិ ិ ឬទមទរ (3) if the arrest, detention or unlawful confinement is committed to secure the payment of a ransom or to demand ្ដ លឱយមនមនុស ្ល ប់។ ឱយបំេពញលកខខណ្ឌអ្វីមយ ួ ។ Page | 100
