Article 49 49 ‫مادة‬ ‫ يجب النتفاء مسئولية مزود الخدمة بدفع تعويض مالي عما يقع من التعدي على‬،‫) من هذا القانون‬48( ‫مع مراعاة أحكام املادة‬ :‫ توافر الشروط الخاصة اآلتية‬،‫أي من الحقوق املقررة بموجب أحكام هذا القانون‬ Subject to the provisions of Article 48 of this Law, a service provider shall not pay a financial compensation for any infringement of any exclusive rights according to the provisions of this Law in the following cases: First: Conditions relating to the first class operations: A. A service provider shall not alter the item's contents in the course of its transmission through its network or system. B. A service provider shall not select the item's recipient unless it is an automatic response to another person's request. Second: Conditions relating to the second class operations: A. A service provider shall not alter the item's contents which are stored in RAM to send them later to other users. B. A service provider shall quickly delete the RAM-stored item in its network or deny access to such item when receiving notice pursuant to the provision of Article 55 of this Law to ensure that it has been deleted or access denied thereto from the site in which it is available. C. A service provider undertakes that it shall not allow access to any simple part of the RAMstored item except for those users who fulfill all the required conditions in the event that such item undergoes certain conditions regarding access thereto from the site in which it is available. D. A service provider shall comply with the rules of re-download, upgrade or renewal of the RAM-stored item if a person who makes the item available requires the same as per an internationally recognized standard transmission protocol of the network or system of the network or system through which it is made available. E. A service provider shall not abuse any technology – in line with the internationally recognized standards, by using it in the site in which such item was available to obtain any information concerning the use thereof. Third: Conditions relating to the third class operations: A. A service provider shall not gain any financial benefit directly attributed to the infringement activity of a right prescribed by the provisions of this Law with respect to such item in the event that a service provider has the ability to control such infringement. B. A service provider shall quickly delete the RAM-stored item in its network or deny access to such item when receiving notice pursuant to the provision of Article 55 of this Law about a claim that such item has been infringed upon or is subject to the infringement activity. ً :‫ الشروط الخاصة بعمليات من الفئة األولى‬- ‫أوال‬ .‫أال يقوم مزود الخدمة في سياق إرسال املادة من خالل شبكته أو نظامه بأي تغيير في محتوى هذه املادة‬ -‫أ‬ .‫ ما لم يكن ذلك عبارة عن استجابة تلقائية لطلب من شخص آخر‬،‫ أال يقوم مزود الخدمة باختيار متلقي املادة‬-‫ب‬ ً :‫ الشروط الخاصة بعمليات من الفئة الثانية‬- ‫ثانيا‬ .‫ لدى إرسالها الحقا ملستخدمين آخرين‬،‫ املخزنة في الذاكرة املؤقتة‬،‫ أال يقوم مزود الخدمة بأي تغيير في محتوى املادة‬-‫أ‬ ‫ متى‬،‫على وجه السرعة بإزالة املادة املخزنة في الذاكرة املؤقتة من شبكته أو بتعطيل الولوج إلى هذه املادة‬ ً ‫ أن يقوم‬-‫ب‬ ‫) من هذا القانون يتضمن أن املادة قد تمت إزالتها أو تم تعطيل الولوج إليها من‬55( ‫تلقي إخطارا طبقا لحكم املادة‬ .‫املوقع الذي أتاحها‬ ‫ أن يكفل مزود الخدمة عدم السماح بالولوج إلى أي جزء غير بسيط من املادة املخزنة في الذاكرة املؤقتة إال‬-‫ج‬ ‫ وذلك في الحاالت التي تخضع فيها هذه املادة لشروط معينة بشأن الولوج إليها في‬،‫للمستخدمين املستوفين للشروط‬ .‫املوقع الذي كان قد أتاحها‬ ‫ذلك‬ ً ‫ إذا اشترط‬،‫أن يلتزم مزود الخدمة بقواعد إ��ادة تحميل أو تحديث أو تجديد املادة املخزنة في الذاكرة املؤقتة‬ ‫ وفقا لبروتوكول إرسال بيانات معياري مقبول على نطاق واسع عامليا‬،‫الشخص الذي أتاح املادة على شبكة معلومات‬ .‫للشبكة أو النظام الذي أتاح املادة من خالله‬ -‫د‬ ً ‫ تستخدم في املوقع الذي كان قد أتاح‬- ‫ تكون متسقة مع املعايير املقبولة عامليا‬- ‫ أال يعبث مزود الخدمة بأية تقنية‬-‫ه‬ .‫املادة بغرض الحصول على معلومات بشأن استخدام هذه املادة‬ ً :‫ الشروط الخاصة بعمليات من الفئة الثالثة‬- ‫ثالثا‬ ُ ‫أال يحصل مزود الخدمة على أية منفعة مالية تعزى مباشرة إلى نشاط التعدي على الحق املقرر بموجب أحكام هذا‬ .‫ وذلك في الحاالت التي يكون ملزود الخدمة الحق ولديه القدرة على التحكم في عملية التعدي‬،‫القانون بشأن املادة‬ -‫أ‬ ‫ متى تلقى‬،‫يقوم على وجه السرعة بإزالة املادة املوجودة على شبكته أو نظامه أو بتعطيل الولوج إلى هذه املادة‬ ً ‫ أن‬-‫ب‬ .‫) من هذا القانون عن إدعاء بأن املادة متعدى عليها أو بأنها محل لنشاط التعدي‬55( ‫إخطارا طبقا لحكم املادة‬ 21
