982 THE PALESTINE Attempts to procure, solicit or incite to commission of offence. GAZETTE 28th September, 1936 31. A n y person who attempts to procure, or attempts to solicit or incite, another to do any act or make any omission, i n Palestine or elsewhere, of such a nature that, if the act were done or the omission made, an offence would thereby be committed under the law of Palestine or the laws i n force i n the place where the act or omission is proposed to be done or made, whether by himself or by that other person, is guilty of an offence of the same k i n d and is liable to the same punishment as if he had himself attempted to do the same act or make the same omission i n Palestine : Provided that if the act or omission is proposed to be done or made at a place outside Palestine, the punishment shall not exceed that which he would have incurred under the laws i n force i n the place where the act or omission was proposed to be done or made, if he had himself attempted to do the proposed act or make the proposed omission : Provided also that i n the last named case a prosecution shall not be instituted except at the. request of the Government of the State having jurisdiction in the place where the act or omission was proposed to be done or made. Preparation to commit crime with explosives. 32. A n y person who makes or knowingly-has i n his possession any explosive substance, or any dangerous or noxious engine, instrument, or thing whatever, with intent by means thereof to commit, or for the purpose of enabling any other person by means thereof to commit, any offence, is guilty of a misdemeanour, and is liable to imprisonment for three years. Neglect to prevent certain offences. 33. E v e r y person who, knowing that a person designs to commit an offence punishable by imprisonment for a term of three years or more, fails to use all reasonable means to prevent the commission or completion thereof, is guilty of a misdemeanour and is liable to imprisonment for two years. Conspiracy to commit a felony. 34. A n y person who conspires with another to commit a felony or to do any act i n any place which if done i n Palestine would be such an offence, and which is an offence under the laws i n force i n the place where it is proposed to be done, is guilty of an offence, and is liable, if no other punishment is provided and the greatest punishment to which a person convicted of the offence i n question is liable is imprisonment for seven years or more, to imprisonment for seven years, or, if the greatest punishment to which a person convicted of the offence i n question is liable is less than imprisonment for seven years, then to such lesser punishment. Conspiracy to commit a misdemeanour. 35. A n y person who conspires w i t h another to commit any offence which is a misdemeanour, or to do any act i n any place which if done i n Palestine would be such an offence, and w h i c h is an offence under the laws i n force i n the place where it is proposed to be done, is guilty of a misdemeanour and is liable to imprisonment for two years. Other conspiracies. 36. A n y person who conspires with another to effect any of the purposes following, that is to say :— (a) to prevent or defeat the execution or enforcement of any law ; o r ( b ) to cause any injury to the person or reputation of any person, or to depreciate the value of any property of any person; or (c) to prevent or obstruct the free and lawful disposition of any property by the owner thereof for its fair value; or
