28th September, 1936 any non-commissioned officer or private of the M i l i t a r y Forces or any member of the Police Force, is guilty of a felony and is liable to imprisonment for five years. Inducing soldiers pr policemen to desert. 56. A n y person who, indirectly:— by any means whatever, directly or ( a ) procures or persuades or attempts to procure or persuade to desert; or (b) (c) aids, abets or is accessory to the desertion o f ; or having reason to believe he is a deserter, harbours or aids in concealing. any non-commissioned officer or private of the M i l i t a r y Forces, or any member of the Police F o r c e , is guilty of a misdemeanour. Aiding prisoners of war to escape. 57. —(1) A n y person who knowingly and advisedly aids an alien enemy of H i s Majesty, being a prisoner of war i n Palestine, whether such prisoner is confined i n a prison or elsewhere, or is suffered to be at large on his parole, to escape from his prison or place of confinement, or if he is at large on his parole, to escape from Palestine, is guilty of a felony and is liable to imprisonment for life. (2) A n y person who negligently and unlawfully permits the escape of any such person as is mentioned i n the last preceding sub-section, is guilty of a misdemeanour. Definition of overt act. Seditious conspiracy and libel. 58. I n the case of any of the offences defined i n this chapter, when the manifestation by an overt act of an intention to effect any purpose is an element of the offence, every act of conspiring w i t h any person to effect that purpose, and every act done i n furtherance of the purpose by any of the persons conspiring, is deemed to be an overt act manifesting the intention. 59. A n y person who :— ( a ) conspires with any other person or persons to do any act in furtherance of any seditious intention common to both or all of them ; o r ( b ) publishes any intention ; o r words or document with a seditious ( a ) without lawful excuse is found i n possession of a document containing a seditious intention; is guilty of a misdemeanour. Seditious intention. 60. —(1) F o r the purposes of the last preceding section a seditious intention is an intentioTi to bring into hatred or contempt or to excite disaffection against the person of H i s Majesty, or against the Mandatory Power or the H i g h Commissioner i n his official capacity or the Government of Palestine, as by law established, or the administration of justice, or to incite or excite inhabitants of Palestine to attempt to procure the alteration otherwise than by lawful means of any matter i n Palestine by law established; or to raise discontent or disaffection amongst inhabitants of Palestine ; or to promote feelings of i l l - w i l l and hostility between different sections of the population of Palestine. (2) Words w h i c h , by inference, suggestion, allusion or i m plication are likely to have any of the effects described i n subsection (1) hereof shall raise a presumption that the person by whom such words were published published them with a seditious
