(b) The Rules of Arbitration in the Authority shall be issued by resolution of the Board of Commissioners, subject to the provisions of the Arbitration Act No. 4 of 2008, as amended. (c) A list of the arbitrators, having expertise and specialization as recognized by the Authority, shall be issued by the Board. Parties may consult this list when an arbitration tribunal is formed. Article 54 Complaints (a) The Board of Commissioners shall review complaints submitted by Users or Licensees related to the application of the provisions of this Law, the Executive Provisions and the Board's resolutions. (b) The Board shall issue regulations called “The Complaints Regulations,” which shall include the rules and procedures for reviewing complaints submitted according to this Article. (c) The Council has the right to deny a complaint in one of the following two cases: 1) If the facts are not within its jurisdiction. 2) If the facts are not supported with evidence. (d) Where a complaint is accepted, the Board's resolution thereupon must include a determination as to whether the facts warrants the imposition of financial penalties, which fall within the Board's jurisdiction, and the taking of decision, where, on such penalties, pursuant to the provisions of Article 55 herein. (e) The aggrieved Licensee or User may claim civil damages before the competent court. (f) The aggrieved party’s right to claim damages shall cease in one year from the date in which a final decision to accept the complaint is issued. Article 55 Fines Imposed by the Authority (a) If it becomes apparent to the Authority that a Licensee is in breach of any provision of this Law, with the exception of the provisions included in Chapter 14 hereof, the Authority shall issue a report of this breach and send a copy of it to the Licensee in breach. (b) In the event a Licensee is in breach of its obligations under this Law, the Executive Provisions or the Regulations of the Authority, the Authority may do the following: 35
