of the elements of deciphering this means was not lodged at the national electronic certification agency against a receipt. In case it is impossible to lodge this copy of the deciphering elements for technical reasons relating to the encryption means, the holder of the encryption means must get a prior authorization from the national electronic certification agency. Art. 2 - Articles 13 (bis), 13 (ter) and 13 (quarter) are added to the above mentioned decree n° 2001-2727 dated 20 November 2001 as follows : Article 13 (bis) : Any natural person or legal entity wishing to get the authorization provided for in paragraph 2 of article 13 of the decree herein, must lodge a request at the national electronic certification agency against a receipt containing the following documents : - a form provided by the national electronic certification agency duly filled up and signed by the applicant, - a copy of the national identity card of the natural person or of the legal entity’s legal representative, - a certificate indicating police record (bulletin n° 3) of the natural person or of the legal entity’s legal representative, - a description of the technical features of the encryption means, - a program and a user’s guide, - a detailed description of the nature of the services to be carried out by the encryption means, - a copy of the certificate approving the encryption means. The national electronic certification agency shall preserve the confidentiality of the data contained in the documents constituting the authorization he was granted. Article 13 (ter) : The national electronic certification agency shall answer the applicant within three months maximum as from the date of receiving the documents provided for above and of providing all the required information, either by delivering or refusing the authorization. In case of refusal, the file is restituted to its holder. The authorization is delivered after having the opinion of the technical commission created within the national electronic certification agency, composed of representatives of the Ministry of the Interior and Local Development, the Ministry of Communication Technologies and the national electronic certification agency. The members of this commission are appointed by order of the Minister of Communication Technologies on a proposal from the concerned ministers and the national electronic certification agency. Article 13 (quarter) : The authorization is granted personally, and may not, under no circumstances, be transferred to third parties. Art. 3 - The Minister of the Interior and Local Development, the Minister of Foreign Affairs, the Minister of Communication Technologies, the Minister of Finance and the Minister of Trade and Handicrafts, each in his respective capacity, shall implement the decree herein which shall be published in the Official Gazette of the Republic of Tunisia.
