The Freedom of Information Bill, 2012 Membership of Commission 9. (1) The Commission shall consists of (a) a chairperson who shall be appointed by the President in accordance with section 10; and (b) two commissioners appointed by the President in accordance with Section 10 (2) The commissioners shall, at their first meeting, elect a vicechairperson from amongst the commissioners appointed under subsection (1) (b) Qualifications for appointment of chairperson and members. 10. (1) A person shall be qualified for appointment as the chairperson of the Commission if the person(a) has knowledge and at least fifteen years experience in matters relating to human rights, law, data protection,transparency or public and corporate governance; (b) holds a degree from a university recognized in Kenya; and (c) meets the requirements of Chapter Six of the Constitution. (2) A person shall be qualified for appointment as a member of the Commission if the person(a) holds a degree from a university recognized in Kenya; (b) has knowledge and at least ten years’ experience in matters relating to any of the following fields(i) law; (ii) data protection; (iii) human rights; (iv) management; or (v) transparency or public and corporate governance; (c) has had a distinguished career in their respective fields; and 9
