In awarding costs, one may take into account factors such as malice or arrogance on the part of the defendant and this is regarded as increasing the injury suffered by the plaintiff, as, for example, by causing him humiliation or distress. Therefore, this means that costs are intended to make good to the aggrieved party as far as money can do for the losses he or she has suffered as the natural result of the wrong done to him or her. In the instant case, the parties have incurred costs in legal proceedings for this hearing, application for registration of the trademark and other costs. It’s on this premise that it would be grave to impose costs on the applicant in the circumstances and therefore, each party shall bear its costs.
