SMAJIĆ v. BOSNIA AND HERZEGOVINA DECISION
imprisonment, suspended for a period of three years and his personal
computer and a laptop were seized (see paragraph 5 above). In the
circumstances of the present case, the Court does not find the penalties
imposed to have been disproportionate.
41. Therefore, having regard to the circumstances of the present case,
the Court considers that the interference with the applicant’s right to
freedom of expression does not disclose any appearance of violation of
Article 10 of the Convention.
42. Accordingly, this complaint is manifestly ill-founded and must be
rejected, in accordance with Article 35 §§ 3 (a) and 4 of the Convention.
C. Other complaints
43. The Court examined the applicant’s remaining complaints under
Articles 9 and 14 of the Convention. However, having regard to all the
material in its possession, and in so far as these complaints fall within the
Court’s jurisdiction, it finds that they do not disclose any appearance of a
violation of the rights and freedoms set out in the Convention. It follows
that these complaints must also be rejected as being manifestly ill-founded,
pursuant to Article 35 §§ 3 (a) and 4 of the Convention.
For these reasons, the Court, unanimously,
Declares the application inadmissible.
