Appendix 1 of Resolution No. 14 dated March 6, 2024 of the
General Election Commission
REGULATION ON CONDUCTING AND CONTROLLING ELECTION ADVERTISING IN
CYBERSPACE
One. General grounds
1.1. This regulation regulates relations related to regular, non-regular and by-election
campaigning using the cyberspace specified in Article 39, Clause 39.2.7 of the Law on Elections
of the State Great Khural of Mongolia and its monitoring.
1.2. Parties, coalitions, candidates and their election organizations participating in the elections
shall follow the laws and regulations of the State Great Khural of Mongolia and this regulation
when conducting election campaigns using electronic media.
1.3. Mobile communication service providers, Internet service providers and online service
providers shall comply with the laws and regulations specified in Section 1.2 of this regulation
during the election period.
1.4. “Online service provider” means a person who delivers content to the public through
websites, electronic tools/applications, and platforms.
1.5. “Candidate's or party's own website” means the website owned and used by the candidate's
own political party or coalition.
1.6. “Social network website in the cyberspace” means the electronic address /page and profile/
of the social network in the cyberspace.
1.7. “Other website” means a website managed or owned by an online service provider .
1.8. “Authority” means the General Election Commission, intelligence agency, central police
agency, and Fair Competition and Consumer Protection Agency.
1.9. In relations not regulated by the regulations, the Law on the Election of the State Great
Khural of Mongolia, the Law on Communications, the Code on Administrative Offenses, the Law
on Procedure of Administrative Offenses, the Criminal Code, the Criminal Procedure Code, the
Law on Personal Data Protection and other relevant laws other relevant laws and regulations
shall be followed.
Two. Principles for election campaigning and monitoring in the cyberspace
2.1. In the framework of the principle of ensuring transparency of election activities, when
posting election advertisements on the website, the information of parties, alliances and
candidates /names, flags, identification symbols, election slogans / shall be clearly visible to the
public.
2.2. The website shall publish the election campaign made by the person authorized to conduct
election campaign as specified in Article 48, Clause 48.3 of the Law on Elections of the State
Great Khural of Mongolia.
2.3. If an election campaign is carried out using social network websites in the cyberspace, it
shall be registered in accordance with Article 47, Section 47.2 of the Law on Elections of the
State Great Khural of Mongolia.
2.4. Election ads created using artificial intelligence, images, sound, video, and audio-visual
recordings with election-related information shall be visibly marked with the word “Generated AI
content” restrictive measures will be taken as indicated.
