A. A single copy of the software to be kept for use in case of the loss or damage of the original ‫ في حالة فقد أو تلف النسخة األصلية التي يحوزها بصفة‬،‫ نسخة واحدة من البرنامج لحفظها بغرض استعمالها‬-‫أ‬ copy held by a legal document or unsuitability for use. .‫مشروعة أو عدم قابليتها لالستخدام‬ ً B. An extracted, adapted or altered copy of the software or translated into another computer ‫ نسخة مقتبسة أو محورة أو ً معدلة من البرنامج أو مترجمة إلى لغة حاسب أخرى إذا كان ذلك ضروريا لتوافقها مع‬-‫ب‬ language if this is necessary for compatibility with a certain computer and limited to the .‫جهاز حاسب معين ومقصورا على االستخدام الخاص للحائز الشرعي للنسخة األصلية‬ exclusive use of the legal holder of the original copy. Religious ceremonies to the extent justified by the nature of such ceremonies. B. Purposes of face-to-face educational activities inside recognized and non-profit educational ‫ وذلك داخل الصفوف‬،‫ أغراض أنشطة التعليم وجها لوجه في املؤسسات التعليمية املعترف بها والتي ال تستهدف الربح‬-‫ب‬ .‫أو األماكن املماثلة املخصصة للتعليم‬ institutions in similar educational classes or places. .‫ويشترط في جميع األحوال عدم الحصول بصورة مباشرة أو غير مباشرة على عائد مالي‬ In all cases, it shall be required that no financial gain shall be achieved directly or indirectly. 28 ‫مادة‬ Article 28 A temporary fixing of a work may be permitted to be carried out by broadcasting corporations by their ‫ التثبيت املؤقت للمصنف من قبل هيئات اإلذاعة بوسائلها الخاصة بغرض استخدامه‬،‫يجوز دون إذن املؤلف ودون أداء تعويض‬ :‫في برامجها اإلذاعية بشرط‬ own methods for the purpose of using it in their own programmes without the author’s permission and without payment of a compensation subject to the following conditions: .‫ أن يكون لهيئة اإلذاعة حق البث اإلذاعي لهذا املصنف‬-‫أ‬ A. Broadcasting corporations shall obtain the right of transmission of such work. B. Broadcasting corporations shall destroy the said fixing six months after completion of the ‫ ويستثنى‬،‫ ما لم يوافق صاحب الحق على مد هذه الفترة‬،‫ أن تتلف هيئة اإلذاعة التثبيت بعد ستة أشهر من إنجازه‬-‫ب‬ .‫من ذلك االحتفاظ بنسخة وحيدة من هذا التثبيت ألغراض أرشيفية‬ said fixing unless the rightful owner agrees to extend such period. An exemption from the above shall apply to retaining a single copy of such fixing for filing purposes. 29 ‫مادة‬ .‫) من هذا القانون على االستعماالت الحرة لألداء والتسجيل الصوتي والبرنامج اإلذاعي‬24( ‫) إلى‬19( ‫تسري أحكام املواد من‬ Article 29 The provisions of Articles from (19) to (24) of this Law shall apply to the free uses of sound performances and recordings and radio programmes. 30 ‫مادة‬ Article 30 .‫ال تخل االستعماالت الحرة ألي مصنف أو أداء بالحقوق األدبية للمؤلفين وفناني األداء‬ Free uses of works and performances shall not prejudice the intangible rights of authors and performing artists. 13
