Article 45 Amended by Law No. (5) of 2014 1- Any person shall be prohibited from breaking or rendering defective any effective technical measure without obtaining its owner's permission. 2- Any person shall be prohibited from displaying to the public, performing, manufacturing, importing, distributing or trading in any media, products or components or displaying or providing any services to the public in the following events: a- Promoting, advertising or marketing any services to overcome any effective technical measure. b- Any services with insignificant commercial use other than those services to break or defect any effective technical measure. c- Any services that are mainly designed, produced or performed to facilitate any breaking or rendering defective of any effective technical measure. 3- Any person shall be prohibited from doing the following without obtaining permission: a- Deliberately deleting or altering any information on the management of rights. b- Distributing or importing any information on the management of rights for distribution purposes although he is aware that such rights have been deleted or altered without permission. c- Distributing or importing for distribution purposes or broadcasting or transmitting to the public copies of artistic works, or phonorecords although he is aware that such rights have been deleted or altered without permission. 4- It is prohibited for any person to manufacture, assemble, modify, import, export, sell, rent or distribute any tangible or intangible instrument or system, whether that person is knows or has reason to believe that such system or instrument are principally used in decoding the encrypted programme-carrying signals transmitted by satellite, without permission from the rightful party. 5- Any person shall be prohibited from deliberately receiving or distributing a programmer’s signal such as a coded signal transmitted by satellites if he is aware that it is decoded without the owner's permission to distribute such signal. 6- The provisions of Paragraphs 1 and 3 of this Article shall not apply to legal activities carried out by civil servants or government contractors in implementation of the Law or investigating crimes or public security or for any similar official purposes. 7- Violating the provisions of subparagraphs from 1 to 5 of this Article shall result in creating a criminal or civil liability, as the case may be, which is separate and independent from any infringement of the prescribed rights according to the provisions of this Law. 45 ‫مادة‬ ُ ”2014 ‫) لسنة‬5( ‫“ استبدلت بموجب القانون رقم‬ .‫ يحظر على أي شخص أن يقوم دون تصريح من صاحب الحق بتعطيل أو تعييب أي تدبير تقني فعال‬-1 ‫ يحظر على أي شخص في أي من الحاالت اآلتية أن يقوم بالعرض للجمهور أو بتقديم أو تصنيع أو استيراد أو توزيع أو‬-2 :‫تداول أية وسائل أو منتجات أو مكونات أو أن يقوم بعرض أو بتقديم أية خدمات للجمهور‬ .‫يتم ترويجها أو اإلعالن عنها أو تسويقها لغرض التحايل على أي تدبير تقني فعال‬ -‫أ‬ .‫ بخالف تعطيل أو تعييب أي تدبير تقني فعال‬،‫ لها هدف أو استعمال تجاري محدود األهمية‬-‫ب‬ .‫ تكون بشكل رئيس ي مصممة أو منتجة أو مؤداة لغرض تمكين أو تسهيل تعطيل أو تعييب أي تدبير تقني فعال‬-‫ج‬ :‫ بأي من اآلتي‬،‫ دون تصريح‬،‫ يحظر على أي شخص القيام‬-3 .‫ مع علمه بذلك‬،‫ حذف أو تغيير أي من معلومات إدارة الحقوق‬-‫أ‬ ‫ مع علمه بأن معلومات إدارة الحقوق قد تم حذفها‬،‫ أو استيراد معلومات إدارة الحقوق بغرض التوزيع‬،‫ توزيع‬-‫ب‬ .‫أو تغييرها دون تصريح‬ ‫ أو اإلذاعة أو النقل أو اإلتاحة للجمهور لنسخ من مصنفات أو أداءات‬،‫ أو االستيراد بغرض التوزيع‬،‫ التوزيع‬-‫ج‬ .‫ مع علمه بأن معلومات إدارة الحقوق قد تم حذفها أو تغييرها دون تصريح‬،‫أو تسجيالت صوتية‬ ‫ يحظر على أي شخص تصنيع أو تجميع أو تعديل أو استيراد أو تصدير أو بيع أو تأجير أو توزيع أي نظام أو وسيلة‬-4 ‫ سواء كان يعلم أو وجد لديه ما يحمله على االعتقاد بأن النظام أو الوسيلة يتم استخدامهما‬،‫ملموسة أو غير ملموسة‬ ‫ دون تصريح من صاحب‬،‫ في فك تشفير إشارات مشفرة حاملة لبرنامج ومرسلة باألقمار الصناعية‬،‫بشكل أساس ي‬ .‫الحق في توزيع هذه اإلشارة‬ ً َّ ‫ صدرت كإشارة ُم‬،‫عمدا باستقبال أو توزيع إشارة حاملة لبرنامج‬ ‫شفرة مرسلة باألقمار‬ ‫ يحظر على أي شخص القيام‬-5 .‫ إذا كان يعلم بأنه قد تم فك تشفيرها دون تصريح من صاحب الحق في توزيع هذه اإلشارة‬،‫الصناعية‬ ‫) من هذه املادة على األنشطة املشروعة التي تتم من قبل موظفي الحكومة أو وكالئها‬3( ‫) و‬1( ‫ ال تسري أحكام الفقرتين‬-6 .‫أو مقاوليها ألغراض إنفاذ القانون أو التحري عن الجرائم أو األمن األساس ي أو ألغراض حكومية مشابهة‬ - ‫) من هذه املادة مسئولية جنائية أو مدنية – بحسب األحوال‬5( ‫) إلى‬1( ‫ يترتب على مخالفة أحكام الفقرات من‬-7 .‫منفصلة ومستقلة عن أي تعد على أي من الحقوق املقررة بموجب أحكام هذا القانون‬ 18
