INTRODUCTION

This application raises the question of whether an Internet search provider is
a publisher of defamatory material identified or contained in its search results.

The plaintiff, Glenn Niemela, seeks an interlocutory injunction compelling
Google Inc. (“Google”) to block from its global search results 146 universal resource
locators (“URLs”) for websites containing defamatory comments about Mr. Niemela.
Google cross-applies for summary judgment dismissing Mr. Niemela’s claims
against it for defamation, breach of privacy, and malicious falsehood. In the
alternative, Google applies to strike portions of Mr. Niemela’s notice of civil claim.
