[2014] 3 S.C.R. standard of reasonable and probable grounds would significantly undermine these objectives, then im­ posing a requirement of urgency and re­strict­ing the purposes for which the search may be con­ ducted would effectively gut them. This stan­dard, in my respectful view, fails to strike the balance re­ quired by s. 8 between the privacy inter­ests of the individual and the state’s interest in pro­tecting the public. l’égard d’un téléphone cellulaire permet de réaliser. [71] Finally, to prohibit cell phone searches in all but “exigent circumstances” is simply not con­ sistent with the structure of our law relating to search incident to arrest. As P. Brown observes in relation to American case law, which has relied on exigent circumstances to justify a cell phone search incident to arrest [71] Enfin, interdire les fouilles de téléphones cel­lulaires en tout temps sauf en « situation d’ur­ gence » n’est simplement pas conforme à la struc­ ture de notre droit en matière de fouille accessoire à l’arrestation. J.L. & Tech. 563, p. 572) [72] I also resist reliance on the statutory provi­ sions adopted in response to this Court’s deci­sion in R. v. Feeney, [1997] 2 S.C.R. 13, to set a stan­ dard that would permit searches of cell phones in­­ ci­dent to arrest. This Court has yet to make any pro­nouncements regarding the constitutionality of s. 529.3 of the Criminal Code, R.S.C. 1985, c. C-46, and I prefer not to rely on its assumed con­sti­tu­ tionality in setting the constitutional parame­ters of cell phone searches incident to arrest.
