Article 56: On the basis of reasoned request of the
concerned bodies, the Authority shall exercise the
following:
1.
Issue an order for the licensee with
consideration to conditioned specified by the
Authority by bridging or changing the direction
of
any
developed
or
proposed
telecommunications system on place where this
body is liable for.
2. Restrain the licensee of establish, maintain,
operate any telecommunications system except
what the Authority directs to execute.
Article 57: The Authority upon the request of the
concerned body or the landlord may make drains
or conduits into, up or through or under or across
any licensee telecommunications system or any
lands for the purpose of lying telecommunications
systems; such licensee is subject to the condition
determined by the Authority.
Article 58: If the licensee in need of a land to
utilize for the provision of telecommunications
services shall reach an agreement with the landlord
or his representative.
If the licensee does not reach an agreement, he
shall file an application to the Authority for the
expropriation property. The Authority shall study
the request and work to reach a compromising
between the concerned parties. If that not possible
with necessity of using the foresaid land, the
Authority shall take the necessary step in
coordination with the concerned bodies to remedy
the matter pursuant to the Expropriation Law
issued by the Royal Decree No 64/78.
بناءً على طلب مسبب من، جيوز للهيئة:)56( املادة
: اآلتي،اجلهات املختصة
مع مراعاة أية شروط، إصدار أمر للمرخص له.1
بردم أو تغيري مسار أي نظام اتصاالت،حتددها اهليئة
يف مكان خاضع لسلطة، أو اقرتح وضعه،مت وضعه
.هذه اجلهة
منع املرخص له من إنشاء أو صيانة أو تشغيل أي.2
نظام اتصاالت عدا ما تقوم اهليئة بالتوجيه
.بتنفيذه
بناءً على طلب اجلهات، جيوز للهيئة:)57( املادة
السماح بإنشاء أعمال متديدات،املختصة أو مالك العقار
أو وضع أنابيب خدمات مرافق يف أو على أو حتت أو
عرب أنظمة اتصاالت ملرخص له أو أية أراضي
وخيض�� هذا،مستخدمة ألغراض أنظمة اتصاالت
.التصريح ألية شروط حتددها اهليئة
على املرخص له إذا احتاج إىل أرض خاصة:)58( املادة
أن،لالنتفاع بها من أجل تقديم خدمات اتصاالت
.يسعى للتوصل إىل اتفاق مع املالك أو من ميثله
جاز له أن يتقدم بطلب إىل،وإذا تعذر عليه ذلك
وتقوم اهليئة بدراسة األمر.اهليئة لنزع ملكية العقار
فإن تعذر ذلك،وحماولة التوفيق بني األطراف املعنية
وأتضح ضرورة استخدام هذا العقار للغرض املشار
فتقوم اهليئة عندها باختاذ اخلطوات الالزمة.إليه
وذلك بالتنسيق مع اجلهات املختصة ملعاجلة األمر
وفقا لقانون نزع امللكية للمنفعة العامة الصادر
