OFFENCES Illegal Access 4. (1) A person who intentionally, without lawful excuse or justification or in excess of a lawful excuse or justification, accesses the whole or any part of a computer system commits an offence punishable, on conviction, by imprisonment for a period not exceeding three years, or a fine not exceeding M25, 000, or both. (2) Where the unauthorised access under subsection (1) is gained by infringing security measures or with the intent of obtaining computer data, a person convicted of the offence under subsection (1) shall be liable to imprisonment for a term not exceeding four years or to a fine not exceeding M35, 000 or both. Illegal Remaining 5. Illegal Interception 6. (1) A person who intentionally, without lawful excuse or justification or in excess of a lawful excuse or justification, by infringing security measures or with the intent of obtaining computer data or other dishonest intent remains logged in a computer system or part of a computer system or continues to use a computer system commits an offence punishable, on conviction, by imprisonment for a period not exceeding [period], or a fine not exceeding [amount], or both. (1) A person who, intentionally without lawful excuse or justification or in excess of a lawful excuse or justification, intercepts by technical means: (a) or any non-public transmission to, from or within a computer system; (b) electromagnetic emissions from a computer system commits an offence punishable, on conviction, by imprisonment for a period not exceeding five years, or a fine not exceeding M50, 000, or both. Illegal Data Interference 7. (1) Subject to subsection 2 and 5, a person who, intentionally without lawful excuse or justification or in excess of a lawful excuse or justification, does any of the following acts: (a) damages or deteriorates computer data; or (b) deletes computer data ; or (c) alters computer data; or (d) renders computer data meaningless, useless or ineffective; or (e) obstructs, interrupts or interferes with the lawful use of computer data; or (f) obstructs, interrupts or interferes with any person in the lawful use of computer data; or (g) it; denies access to computer data to any person authorized to access commits an offence punishable, on conviction, by imprisonment for a
