(4) A service provider shall, at the p r o v i d e r ' s o w n expense, acquire t h e facilities and devices specified in the regulations m a d e under subsection (2). (5) Subject to this A c t any cost incurred by a service provider for the purpose of— (a) e n a b l i n g — (i) any electronic c o m m u n i c a t i o n to be intercepted: and (ii) call-related information to be stored; and (b) c o m p l y i n g with this Part; shall be borne by the service provider. PART X I I ACCESS TO STORED 80. (1) COMMUNICATION Except as otherwise provided under this Act, a Prohibition of s c o m m u n i c a t i o n w h i c h is electronically communication stored by the service provider. (2) A person w h o c o n t r a v e n e s subsection (1) c o m m i t s an offence and is liable, upon conviction, to a fine not exceeding five hundred thousand penalty units or to imprisonment for a period not exceeding five years, or to both. (3) A provider of remote computing services shall not disclose to any other person the contents o f any communication which is carried or maintained on the remote c o m p u t i n g service on behalf of a subscriber or solely for the purpose of providing storage or computer processing services t o a subscriber, if the provider is not authorised to access the contents of the communication for purposes of providing any service other than storage or computer processing. (4) A provider of a remote c o m p u t i n g service or electronic communication service shall not disclose to any person a record or other information relating to a subscriber or customer of the service.
