THE PALESTINE 1036 GAZETTE 28th September, 1936 Provided that any person who is charged w i t h any offence under this section may be tried before a court competent to try the person charged with having so stolen, taken, extorted, obtained or disposed of the property, and shall i n that case be liable to the same punishment as the offender by whom the property was stolen, extorted, unlawfully obtained or disposed of. Receiving property fraudulently obtained. 310. A n y person who, by himself or b y an agent, receives or takes upon himself, either alone or jointly w i t h any other person, the control or disposition of any thing, money, valuable security or other property whatsoever, knowing the same to have been unlawfully taken, obtained, converted or disposed of i n a manner which constitutes a misdemeanour, is guilty of a misdemeanour and is liable to the same punishment as the offender by whom the property was unlawfully obtained, converted or disposed of. Unlawful possession of property. 311. A n y person who has i n his possession any t h i n g , money, valuable security or other property whatsoever, which is reasonably suspected of being stolen property, is, unless he establishes to the satisfaction of a court that he acquired the possession of it lawfully, guilty of a misdemeanour and is liable to imprisonment for six months, or to a fine of fifty pounds or to both such penalties. A n y person who, being a trustee of any property, the property with intent to defraud, or, w i t h intent to converts the property to any use not authorised by the guilty of a felony and is liable to imprisonment for seven destroys defraud, trust, is years. F o r the purposes of this section the term "trustee" includes the following persons and no others, that is to say :— ( a ) trustees upon express trusts created by a deed, w i l l or instrument in writing, whether for a public or private or charitable purpose; (b) trustees appointed by or under for any such purpose ; the authority of a law (c) persons upon whom the duties of any such trust as aforesaid devolve; (d) Directors and officers of corporations fraudulently appropriating property, or keeping fraudulent accounts or falsifying books or accounts. 313. executors and administrators. A n y person who :— ( a ) being a director or officer of a corporation or company, receives or possesses himself as such of any of the property of the corporation or company otherwise than i n payment of a just debt or demand, and, w i t h intent to defraud, omits either to make a full and true entry thereof in the books or accounts of the corporation or company, or to cause or direct such an entry to be made therein; or (b) being a director, officer or member of a corporation or company, does any of the following acts with intent to defraud, that is to say :—
