CHIDYAUSIKU CJ: The applicant in this case is the Law Society of Zimbabwe,
established in terms of the Law Society of Zimbabwe (Private) Act [Chapter 223] of
1974. It has capacity to institute legal proceedings in terms of section 51 of the Legal
Practitioners Act [Chapter 27:07]. Although the papers do not expressly allege this, this
application is brought in terms of s 24 of the Constitution of Zimbabwe ( the
