The Removing and Blocking of Unlawful Content (Procedure, Oversight and Safeguard) Rules 2021, formulated under Sections 37(2) and 51 of PECA 2016, are currently being challenged before the Islamabad High Court. These Rules seek to define terms such as "glory of Islam," "security of Pakistan," "decency and morality," and "integrity or defence of Pakistan"—terms that serve as limitations on the constitutional right to freedom of expression under Article 19 of the Constitution of Pakistan. The Pakistan Telecommunication Authority (PTA) is empowered under these Rules to remove or block online content based on perceived violations of these subjective terms. This delegation of authority to an administrative body, rather than constitutional courts, to interpret and enforce such fundamental limitations on speech, raises concerns regarding the separation of powers. Furthermore, Chapter IV of the Rules introduces stringent oversight of Internet service providers and social media companies, mandating their compliance with local laws and requiring significant social media companies to register, establish offices, and appoint compliance officials in Pakistan. These provisions pose serious implications for online freedom, privacy, and the security of online content producers.
