ON THE AMENDMENT TO THE CODE ON ADMINISTRATIVE OFFENSES
Article 1. The following article and section with the following content shall be added to the the Code on
Administrative Offenses:
1/ Paragraphs 2-4 of Article 6.22:
"2. Without the consent of a resident, placing an audio, video, audio-visual recording device at the entrance and exit of
a family or household living in a public apartment, and making a recording, if it does not lead to criminal liability, a
person shall be fined five hundred units, and a legal entity five shall be fined in the amount of one thousand units.
3. Showing or copying audio, visual, audio-visual recordings to others without the permission of the person will result
in a fine of 500 MNT for a person and 5000 MNT for a legal entity.
4. If an audio, video, audio-visual recording device is placed in a location to clearly infringe on the individual's right to
to privacy and freedom of the individual, and the recording does not result in criminal liability, a person shall be fined
in the amount of eight hundred units, and a legal entity shall be fined in the amount of eight thousand units.
Note:- "Place of obvious violation of the right to privacy and freedom of the individual" specified in this article is a
bathroom, changing room, special service room of a public service office, karaoke room, hotel room, and treatment
room for providing health care and services.
2/ Article 6.27:
Article 6.27. Violation of the Law on Personal Data Protection
1. If a person's personal data is used for a purpose other than the basis provided by the law and the purpose for which
the person was originally authorized, the person shall be fined in the amount of five hundred units, and the legal entity
shall be fined in the amount of five thousand units.
2. If, as a result of electronic processing of data without human intervention, the rights and freedoms of the data subject
are violated and a decision is made that may cause negative legal consequences, the person shall be fined in the amount
of five hundred units, and the legal entity shall be fined in the amount of five thousand units.
3. If the illegal acquisition, processing, transmission or disclosure of a person's sensitive data does not result in criminal
liability, the person shall be fined in the amount of two thousand units, and the legal entity will be fined in the amount
of twenty thousand units."
Article 2. This law shall be enforced from the date of entry into force of the Law on the Personal Data
Protection.
