Act No. 32, 2008 LIQUOR PRODUCTS AMENDMENT ACT. 2008 (ii) (iii) (c) c o m p l e t i n g or terminating such alcoholic fermentation; or the addition of a prescribed spirit derived from grapes[,] to [the] j u i c e of such [fresh] g r a p e s or such fermented juice; and [be p r o d u c e d ] in such a m a n n e r that it c o m p l i e s with the prescribed r e q u i r e m e n t s for wine or a particular prescribed class thereof.". A m e n d m e n t of section 11 o f A c t 6 0 of 1989 5. Section 11 of the principal Act is hereby a m e n d e d by the substitution for subsection (1) of the following subsection: " ( 1 ) N o person shall sell any liquor product in a container, unless the prescribed particulars of such liquor product are indicated in the prescribed m a n n e r on the label [thereof] of such container and on the p a c k a g e of such c o n t a i n e r . " . Insertion of s e c t i o n 1 3 A in A c t 6 0 of 1989 6. T h e following section is hereby inserted in the principal Act before section 14: " R e s t r i c t i o n o n use of g e o g r a p h i c a l n a m e s 13A. (1) T h e Minister may, taking into account the R e p u b l i c ' s international obligations or a g r e e m e n t s with other countries, by notice in the Gazette restrict the use of specified geographical n a m e s in c o n n e c t i o n with the sale or export of a specified liquor product, on such c o n d i t i o n s as m a y be specified in such notice. (2) A notice issued in terms of subsection (1) shall also apply w h e r e the geographical name concerned— (a) is used in conjunction with an indication of the true origin of the liquor product; (b) is translated; or (c) is a c c o m p a n i e d by an expression such as ' k i n d ' , ' t y p e ' , ' s t y l e ' . ' i m i t a t i o n ' or any similar e x p r e s s i o n . " . A m e n d m e n t o f section 14 of A c t 6 0 of 1989 7. Section 14 of the principal Act is hereby a m e n d e d by the substitution for subsection (1) of the following subsection: " ( 1 ) T h e Minister may, on the r e c o m m e n d a t i o n of the board, by notice in the Gazette establish a s c h e m e in respect of [wine, b r a n d y r e f e r r e d to in section 9(l)(a) or (b) of t h e W i n e a n d Spirit Control A c t , 1 9 7 0 ( A c t N o . 47 of 1970), o r a g r a p e - b a s e d l i q u o r ] a liquor product derived from g r a p e s , with a view to further regulating particular matters relating to the production and sale of such liquor products, including the granting of [ a u t h o r i z a t i o n s ] authorisations for the use of particulars referred to in section 1 l(3)(a) and (4) in c o n n e c t i o n with the sale of the said liquor p r o d u c t s . " . 1 A m e n d m e n t o f section 16 of A c t 6 0 of 1989 8. Section 16 of the principal Act is hereby a m e n d e d — (a) by the substitution in subsection (3) for p a r a g r a p h (a) of the following paragraph: "(a) Subject to [the p r o v i s i o n s of] paragraph (b) and the international obligations of the R e p u b l i c , an import certificate shall be issued only if— (i) the product concerned is w i n e , an alcoholic fruit b e v e r a g e , a spirit, a grape-based liquor or a spirit-based liquor; and (ii) in the case of a product imported in the c o n t a i n e r s in w h i c h it is to be sold in the Republic, the [labels] particulars on those containers and on the p a c k a g e of such c o n t a i n e r s c o m p l y with the applicable r e q u i r e m e n t s of this A c t . " ; (b) by the deletion in subsection (3)(b) of s u b p a r a g r a p h (iv); and
