4. A juvenile referred to in Section 2 of this Article may not be sentenced if he is unable to fully realize the illegality of his actions or inactions and the harm caused by them due to retardation of mental development. Article 6.3. Liability 1. Criminal liability shall be imposed on the person capable of taking responsibility for the crime. /This section was amended by the law of May 11, 2017/ 2. Inability to realize the real nature and dangerousness of one's actions and to control them due to mental illness or lack of intelligence shall be considered incompetent. 3. Medical coercive measures prescribed in this law shall be applied without imposing punishment on a person who was incapable of taking responsibility for the crime at the time of committing the crime. 4. In the event that he is unable to take charge of the case after committing the crime, the court shall apply coercive measures of medical quality to him and sentence him after recovery. /This section was amended by the law of May 11, 2017/ Article 6.4. Punishment of a person who commits a crime while intoxicated 1. Committing a crime while drunk or intoxicated is not a ground for exemption from criminal responsibility. /This section was amended by the law of May 11, 2017/ 2. If a person who commits a crime while intoxicated is found to be suffering from alcoholism or drug addiction, medical coercive measures specified in Article 7.4 of this law may be applied in addition to the punishment imposed on him. Article 6.5. Circumstances of mitigating criminal responsibility /The title of this article was amended by the law of May 11, 2017/ 1. In the case where the circumstances specified in paragraph 1 of this article are specified in the special section of this law as criminal, the circumstances of mitigating criminal responsibility shall not be considered. /This section was amended by the law of May 11, 2017/ 3. Circumstances aggravating criminal liability /The title of this article was amended by the law of May 11, 2017/ 1. When imposing criminal liability, the court shall consider the following aggravating circumstances: /This section was amended by the law of May 11, 2017/ 1.1. causing physical and emotional pain and suffering in an extremely cruel and insulting manner; 1.2. commits two or more intentional crimes specified in one chapter of a special class of this law, or commits a group of crimes; /This provision was amended by the law of May 11, 2017/ 1.3. committed in a manner dangerous to the public; 1.4. committed for the purpose of concealing or simplifying another crime; 1.5.committed against the victim and his close relatives in connection with the performance of official duties and public duties; 1.6. committed against a person under his control, knowing the victim's inability to defend himself; 1.7. committed by taking advantage of state of emergency, disaster, dangerous phenomenon, public disorder; 1.8. The person who pleaded guilty and was obliged to pay damages did not fulfill the obligation imposed by the court. 2. In cases where the aggravating circumstances specified in the special class of this law are specified as a crime, criminal liability shall not be considered as an aggravating circumstance. /This section was amended by the law of May 11, 2017/
