(1) Пробацията е съвкупност от мерки за контрол и въздействие без лишаване от свобода, които се налагат заедно или поотделно. (2) (Изм. - ДВ, бр. 103 от 2004 г., в сила от 01.01.2005 г.) Пробационните мерки са: 1. задължителна регистрация по настоящ адрес; 2. задължителни периодични срещи с пробационен служител; 3. ограничения в свободното придвижване; 4. (изм. - ДВ, бр. 75 от 2006 г., в сила от 13.10.2006 г.) включване в курсове за професионална квалификация, програми за обществено въздействие; 5. поправителен труд; 6. безвъзмезден труд в полза на обществото. (3) (Изм. - ДВ, бр. 103 от 2004 г., в сила от 01.01.2005 г.) Пробационните мерки са с продължителност: 1. от 6 месеца до три години - за мерките по ал. 2, т. 1 - 4; 2. от три месеца до две години - за поправителния труд; 3. от 100 до 320 часа годишно за не повече от три поредни години - за безвъзмездния труд в полза на обществото. (4) (Изм. - ДВ, бр. 103 от 2004 г., в сила от 01.01.2005 г.) Мерките по ал. 2, т. 1 и 2 се налагат задължително на всички осъдени на пробация, а мерките по ал. 2, т. 5 и 6 не се налагат на непълнолетни лица, ненавършили 16-годишна възраст. (5) Пробацията се изпълнява по ред, определен със закон. amend. - SG 103/04, in force from 01.01.2005) Probation is a totality of measures for control and impact without imprisonment, which are imposed together or separately. (2) (Amend. - SG 103/04, in force from 01.01.2005) The probation measures shall be: 1. obligatory registration at the present address; 2. obligatory periodical meetings with a probation employee; 3. restrictions of the free movement; 4. (amend. - SG 75/06, in force from 13.10.2006) inclusion in courses for professional qualification, programmes for public influence; 5. correctional labour; 6. gratuitous work in favour of the society. (3) (Amend. - SG 103/04, in force from 01.01.2005) The probation measures shall be with duration: 1. from 6 months to three years – for the measures of para 2, items 1 – 4; 2. from three months to two years – for the correctional labour; 3. from 100 to 300 hours for not more than three consecutive years – for the gratuitous labour in favour of the society. (4) (Amend. - SG 103/04, in force from 01.01.2005) The measures of para 2, items 1 and 2 shall be imposed obligatory to all sentenced to probation and the measures of para 2, items 5 and 6 shall not be imposed to under-aged persons, not rounded 16 years of age. Пробационната мярка задължителна регистрация по настоящ адрес е явяване и подписване на осъдения пред пробационния служител или определено от него длъжностно лице в съответствие с определената от съда периодичност, но не по-малко от два пъти седмично. (2) Пробационната мярка задължителни периодични срещи с пробационен служител се провежда в пробационната служба, на чиято територия е настоящият адрес на осъдения. По Art. 42b. (New – SG 103/04) (1) (Suppl. - SG 27/09, in force from 01.06.2009) The probation measure obligatory registration at the present address shall be appearing and signing by the sentenced before the probation employee or official, determined by him, according to the schedule specified by the court at least twice per week. (2) The probation measure obligatory periodical meetings with the probation employee shall be conducted at the probation office on which territory is the present address of the sentenced. As exception they can be conducted at another appropriate place, determined by the probation employee, if important reasons impose this. The meetings shall be planned or extraordinary upon request by the probation employee or the sentenced.
