work that has been published in his name, shall be the rightful owner of the intangible and financial

rights in respect of the collective work unless there is a written agreement to the contrary.

Article 34
ً
An author who has produced a derivative work shall be deemed as the owner of the intangible and دون املساس بحقوق مؤلف املصنف،يعتبر املؤلف الذي أنجز املصنف املشتق مالكا للحقوق األدبية واملالية على هذا املصنف

financial rights of such work without prejudice to the rights of the original work from which the said
work has been derived.
Article 35

ً
1- Everyone who participates in creating such work shall be deemed as a co-author of the
: وبوجه خاص،يعتبر مؤلفا شريكا في املصنف السمعي البصري كل من ساهم في ابتكار هذا املصنف
audiovisual work, particularly the following:
. مؤلف السيناريو أو صاحب الفكرة املكتوبة للمصنف-أ
a- Script writer or the owner of a written concept of the work.

. من قام بتحوير مصنف أدبي سابق الوجود بشكل يجعله مالئما لألسلوب السمعي البصري-ب
b- Everyone who adapts a pre-existing literary work in a manner making it suitable for the
audiovisual format.
c- Dialogue writer.

d- Sound track composer if it is specifically composed for the work.
. واضع املوسيقى التصويرية إذا قام بوضعها خصيصا للمصنف-د
. املخرج إذا بسط رقابة فعلية وقام بعمل إيجابي من الناحية الفكرية إلنجاز املصنف-ه
e- Director if he exercises actual control and has undertaken positive work intellectually for
completion of the work.
2- If a co-author involved in creating an audiovisual work refuses to complete the part for which فال يحول ذلك دون حق باقي،إذا امتنع أحد الشركاء في تأليف مصنف سمعي بصري عن إتمام الجزء الخاص به
he is responsible, this shall not bar the other co-authors from exploiting what has been وذلك مع عدم اإلخالل بما قد يكون للممتنع من حقوق ناشئة عن مساهمته في،الشركاء في استغالل ما تم إنجازه

completed without prejudice to the person who so refuses to enjoy the rights arising from his
participation in such work.

3- A producer of an audiovisual work shall be the representative of the authors of such work, يكون منتج املصنف السمعي البصري نائبا عن مؤلفي هذا املصنف – عدا مؤلفي املصنفات املوسيقية– بشأن
. ما لم يتفق كتابة على غير ذلك،استغالل حقوقهم على هذا املصنف
except for composer of the musical works, with respect to exploiting their rights in respect of
such work, unless otherwise agreed upon in writing.

Article 36
The author’s financial rights according to the provisions of this Law, shall belong to the owner or the إنجاز- بناء على تكليف منه- ً لصاحب العمل أو ملن تم لصالحه، املقررة بموجب أحكام هذا القانون،تكون الحقوق املالية

the implementation of a contract or obligation the content of which is the full dedication of efforts for
producing the work, performance or audio recording unless otherwise agreed upon in writing.
