‫ أو التخلص من‬،‫املصادرة واإلتالف على نفقة املحكوم عليه لكافة السلع التي يثبت لديها بأنها تنطوي على تعد‬ .‫هذه السلع خارج القنوات التجارية إذا ترتب على اإلتالف ضرر غير معقول بالصحة العامة أو البيئة‬ a- Confiscation or destruction of the goods subject to the infringement at the convicted party's expense or disposal thereof outside the commercial channels if such destruction will result in unreasonable damage to public health and environment. b- Confiscation or destruction of all the materials, machines and equipment used in the infringement or the prohibited acts if it is proved that such acts were purposely committed or dispose thereof outside the commercial channels if such destruction will result in unreasonable damage to public health and the environment. If the act of infringement is proved, the Court may pass a ruling for confiscation of any assets that are related to the infringement activity. -‫أ‬ ‫ مصادرة وإتالف جميع املواد واألدوات واملعدات التي استخدمت في التعدي أو ارتكاب الفعل املحظور إذا ثبت‬-‫ب‬ ً ‫ أو التخلص منها هذه األشياء خارج القنوات التجارية إذا ترتب على اإلتالف ضرر غير معقول‬،‫لديها أنه كان عمديا‬ .‫بالصحة العامة أو البيئة‬ ‫وللمحكمة إذا ثبت لديها التعدي أو ارتكاب الفعل املحظور أن تقض ي بمصادرة أية أصول تعزى إلى نشاط التعدي‬ .‫أو الفعل املحظور‬ 66 ‫مادة‬ Article 66 ُ ”2014 ‫) لسنة‬5( ‫“ استبدلت بموجب القانون رقم‬ "Amended by Law No. (5) of 2014" :‫مع عدم اإلخالل بأية عقوبة أشد ينص عليها أي قانون آخر‬ Without prejudice to any severer penalty provided for in any other law: A. Imprisonment of up to 6 months or a fine not exceeding 2,000 dinars shall be imposed on ‫ يعاقب بالحبس مدة ال تزيد على ستة أشهر أو بالغرامة التي ال تجاوز ألفي دينار كل من خالف أمرا تصدره املحكمة‬-‫ب‬ parties of the claim, judges’ agents or those appointed to the court who violate a court order ‫من أطراف الدعوى أو أعوان القضاة أو الخاضعين لوالية املحكمة بشأن حماية املعلومات السرية التي تظهر أو يتم‬ in regards to the protection of confidential information that are disclosed or exchanged .‫تبادلها في سياق أية إجراءات قضائية‬ during the judicial proceedings. ‫الفصل الرابع عشر‬ Chapter fourteen Miscellaneous Provisions ‫أحكام متفرقة‬ 67 ‫مادة‬ Article 67 ً Officers appointed by the Minister to ascertain of the implementation of the provisions of this Law and ‫يكون للموظفين الذين يعينهم الوزير للتحقق من تنفيذ أحكام هذا القانون والقرارات التي تصدر تنفيذا له سلطة دخول املحال‬ .‫ذات الصلة‬ orders issued to implement it, shall be entitled to have access to the relevant shops.
