Second: If the performance is included in phonorecords protected pursuant to the provisions of this Law. Third: If the performance is incorporated in a broadcasting transmission that is protected under this Law in case the performance is not fixed in a phonorecord. .‫ إذا تم إدراج األداء ضمن تسجيل صوتي محمي بموجب أحكام هذا القانون‬:‫ثانيا‬ ً .‫ إذا كان األداء مدرجا في بث إذاعي محمي بموجب هذا القانون في حالة عدم تثبيت األداء في تسجيل صوتي‬:‫ثالثا‬ Article 75 The provisions of this Law related to protection of producers of phonorecords shall be applicable to phonorecords: A. that have been produced by citizens of the Kingdom. B. that have been fixed for the first time in the Kingdom. C. that have been published for the first time in the Kingdom. 75 ‫مادة‬ :‫تسري أحكام هذا القانون املتعلقة بحماية منتجي التسجيالت الصوتية على التسجيالت الصوتية‬ Article 76 The provisions of this Law related to protection of broadcasting corporations shall be applicable to radio programmes of broadcasting corporations: A. that have their head office situated in the Kingdom. B. that transmit from transmission stations situated in the Kingdom. 76 ‫مادة‬ :‫تسري أحكام هذا القانون املتعلقة بحماية هيئات اإلذاعة على البرامج اإلذاعية لهيئات اإلذاعة‬ .‫ التي يكون منتجوها من مواطني اململكة‬-‫أ‬ .‫ التي تم إنجاز أول تثبيت لها في اململكة‬-‫ب‬ .‫ التي تم نشرها ألول مرة في اململكة‬-‫ج‬ .‫التي يكون مقرها الرئيس ي في اململكة‬ -‫أ‬ .‫ التي تبث من محطات إرسال تقع داخل اململكة‬-‫ب‬ 77 ‫مادة‬ Article 77 Without prejudice to the provisions of Articles (73) to (76), the provisions of this Law shall be applicable ‫ تسري أحكام هذا القانون على املؤلفين وفناني األداء ومنتجي‬،‫) من هذا القانون‬76( ‫) إلى‬73( ‫مع عدم اإلخالل بأحكام املواد من‬ to authors, performing artists, phonorecord producers and broadcasting corporations that enjoy ‫التسجيالت الصوتية وهيئات اإلذاعة الذين يتمتعون بالحماية بموجب أي من االتفاقيات الثنائية أو الدولية املعمول بها في‬ .‫اململكة‬ protection pursuant to international agreements ratified by the Kingdom. 78 ‫مادة‬ Article 78 The provisions of this Law shall be applicable to works, performances, phonorecords and broadcasting ‫تسري أحكام هذا القانون على املصنفات واألداءات والتسجيالت الصوتية والبرامج اإلذاعية التي أنجزت أو بثت قبل تاريخ العمل‬ stations completed or fixed prior to the effective date of this Law, provided that they have become public ‫ على أال تكون قد آلت إلى ا ِمللك العام بانقضاء مدة الحماية املقررة لها في القانون السابق أو في التشريعات‬،‫بأحكام هذا القانون‬ .‫املعمول بها في بلدها األصلي‬ property as a result of the expiry of the protection period prescribed therefor under the former Law or in a legislation currently in force in their native country. ‫الفصل السادس عشر‬ Chapter Sixteen Final Provisions ‫أحكام ختامية‬ 36
