The resolution of the Senate under paragraph one shall be passed by votes of not
less than three-fourths of the total number of the existing members of the Senate.
Section 22. There occurs any event that the NBTC fails to perform their duties
efficiently as stipulated by law, the following persons shall have the right to lodge with
the President of the Senate in order to request that the Senate pass a resolution removing
all NBTC Commissioners from office:
(1) Members of the House of Representatives of not less than one-fourth of the
total number of the existing members of the House;
(2) Members of the Senate of not less than one-fourth of the total number of the
existing members of the Senate;
(3) Not less than 20,000 people who are service users affected by the act
according to paragraph one. The complaint must be lodged with the President
of the Senate in accordance with the criteria specified by the President of the
Senate.
A resolution of the Senate under paragraph one shall be passed by votes of not less
than two-thirds of the total number of the existing members of the Senate. In making the
resolution, the Report of the Monitoring and Evaluation Committee submitted to the
Senate in accordance with Section 72 must be taken into consideration.
In the case where all the Commissioners vacate office upon the cause under
paragraph one, the vacating Commission shall remain in office only as necessary until the
new Commissioners take office.
Part 6
Meetings, Powers and Duties of the Commission
Section 23. The conduct of meetings, making resolutions and performing duties of
the NBTC shall be in accordance with the rules and regulations prescribed by the NBTC.
Any Commissioner having interest in the matter under consideration shall not
have right to attend the meeting.
In performing its duties, the NBTC may appoint one or more than one
Commissioner to act on its behalf. The NBTC may not deny any liability on grounds that
the Commissioners have been entrusted to perform such duties.
Section 24. The conduct of duties of the NBTC, BC and TC in matters relating to
or having impacts on public interest shall be undertaken by the resolution of the meeting.
The minutes of the meeting and results of the decisions made individually and as a group
shall be disclosed to the public through electronic media of the Office of the NBTC and
any other appropriate mean as prescribed by the NBTC.
