незаконно завладее въздухоплавателно средство, намиращо се на земята или в полет, или кораб, намиращ се в морските пространства или във вътрешните водни пътища на Република България или в открито море, или на неподвижна платформа, разположена върху континенталния шелф, или установи контрол върху такива средства, се наказва с лишаване от свобода до десет години. (2) Ако деянието по предходната алинея е извършено със сила или заплашване, наказанието е лишаване от свобода от три до дванадесет години. (3) Ако от деянието по предходните алинеи е последвала: а) (доп. - ДВ, бр. 101 от 2017 г.) значителна повреда на въздухоплавателното средство, на кораба или на платформата; б) средна или тежка телесна повреда на едно или повече лица независимо от това, дали са настъпили последиците по предходната буква; в) (изм. - ДВ, бр. 153 от 1998 г., изм. - ДВ, бр. 75 от 2006 г., в сила от 13.10.2006 г.) смърт на едно или повече лица независимо от това, дали са настъпили последиците по букви "а" и "б", наказанието е: по букви "а" и "б" лишаване от свобода от пет до петнадесет години, а по буква "в" - лишаване от свобода от десет до двадесет години или доживотен затвор без замяна, като съдът може да постанови и лишаване от права по чл. 37, ал. 1, точки 6 - 10. an aircraft on the ground or in flight, or over a ship located in the maritime spaces or in the internal waterways of the Republic of Bulgaria or in the open sea, or over a fixed platform located on the continental shelf, or establishes control over such facilities, shall be punished by imprisonment of up to ten years. (2) If the act under the preceding para has been committed with force or threat, the penalty shall be imprisonment of three to twelve years. (3) If the act under the preceding paras has incurred: a) (suppl. – SG 101/17) considerable damage to the aircraft, of a ship or of the platform; b) average or severe bodily injury to one or more persons, regardless of whether the consequences under the preceding letter have occurred; c) (amend. - SG 153/98; amend. – SG 75/06, in force from 13.10.2006) death of one or more persons, regardless of whether the consequences under letter "a" and "b" have occurred, the penalty shall be: under letter "a" and "b" imprisonment of five to fifteen years, and under letter "c" imprisonment of ten to twenty years or life imprisonment without parole, whereas the court can also rule revoking of rights under art. 37, para 1, items 6 - 10. (New - SG 95/75; revoked - SG 41/85, new – SG 101/17) (1) Whoever places on a ship, located in the exclusive economic zone of the Republic of Bulgaria or in open sea a device or substance which may destroy or damage it, or destroy the load on the ship, if the act is of a nature to threaten the safe sailing of the sip, shall be punished by imprisonment from 3 to 12 years. (2) With the punishment under Para. 1 shall be punished, that one, who places on a fixed platform, placed on the continental shelf, a device or substance, which may destroy it or is of a nature to threaten its safety. (3) Whoever threatens the safe sailing of a ship by: 1. destroying, damaging or violating the work of sea, or river navigation equipment; 2. announcing information or giving a signal, which he knew to be false, placing a false sign or removing or moving a sign intended to guarantee safety of movement, shall be punished by imprisonment from 3 to 15 years. (4) Whoever commits violence towards a person on the ship, if the act is of a nature to threaten the safe sailing of the ship and is not a more severe crime, shall be punished by imprisonment from 5 to 10 years.
