Decree n° 2007-1071 dated 2 May 2007, amending and
completing decree n° 2001-2727 dated 20 November
2001 fixing the conditions and procedures of using
the means and services of encryption through the
telecommunications systems, as well as the exercise
of the relevant activities.
The President of the Republic,
On a proposal from the Ministers of National Defence
and of Communication Technologies,
Having regard to organic law n° 2004-63 dated 27 July
2004, relating to the protection of the data having a
personal nature,
Having regard to law n° 91-44 dated 1 July 1991,
organizing the commerce distribution sector, as
amended and completed by law n° 94-38 dated 24
February 1994,
Having regard to law n° 91-64 dated 29 July 1991,
relating to competitiveness and prices, all amending and
completing texts, and notably law n° 2005-60 dated 18 July
2005,
Having regard to law n° 92-117 dated 7 December
1992, relating to the consumer’s protection,
Having regard to law n° 94-41 dated 7 March 1994,
relating to foreign trade,
Having regard to law n° 2000-83 dated 9 August 2000,
relating to exchange and electronic commerce,
Having regard to the telecommunications code
promulgated by law n° 2001-1 dated 15 January 2001, as
completed by law n° 2002-46 dated 7 May 2002, and
notably article 9,
Having regard to decree n° 2001-2727 dated 20
November 2001, fixing the conditions and procedures of
using the encryption means or services through the
telecommunication networks, as well as exercising the
relevant activities,
Having regard to the opinion of the Ministers of the
Interior and Local Development, of Foreign Affairs, of
Finance and of Trade and Handicrafts,
Having regard to the opinion of the Administrative
Court.
Decrees the following :
Article one - The provisions of the second paragraph of
article 13 of the above mentioned decree n° 2001-2727
dated 20 November 2001, are repealed and replaced by the
following :
Article 13 (paragraph 2 new) : The use of any other
encryption means of the second category through the
telecommunication networks is prohibited as long as a copy
