JULY 558 24,2023 5- hs.rtiotr of n.w sectiotr 24A, Act XL of 2016.-ln IPART I Act XL of 2016, after section 24, the following new seclion 24A. shall be inserted, namely:- "24A. Cybcrbullyiry.-{l) A p€rson comrnits the offmce of cyterbullying rvho, with inten( to harass, threaten or larget another person posts or scnds electronic messages, including pictures or videos by usinB any social media plalform, including chat rooms, blogs or instant messaging. (2) A minor through his guardran may apply to the Authority for or blocking access to such content or communication rEmoval, destruction of referred to in sub-section (1). (3) The Authority, on receipt ofapplication under sub-section (2), shall fonhu'ith pass such orders as deemed appropriate in the circumslances including En order for removal, destruction, preventing lransmission of or blocking access to such content and communication. (4) The Authority shall, before passing an order uDder sub-section (3), seek report from investigation agency whether or not such content is required for investigation or pros€cution purposes. (5) Whoever commits the olfence of child cyberbullying as described in sub-section (l), shall be punished with imprisonment of either description for a term which may extend to five years but shall not be less than one year *ith a fine of up to five hundred thousand rupees and shall not less than one hundrcd thousand lupees.". 6. ArneldmeDt of !€ction 30, Act XL of 2016.-In Act XL of20l6, for scction 10, dle followidg shall be substituted, nam€ly:"30. Power rnd procedurE to iovestigrte.-{l) In addition to the Federal Investigation Agency, the Police shall be authorized to takc cognizrrca ofthc ofTences ulder this Act.
